We <br /> have in reviewing the correspondence noted the kind of issues Mr. McCoy described as <br /> having been presented to the Planning Commission, we are familiar with the issues we <br /> - are addressing. We are certainly happy, and do invite members of the public to address <br /> those same issues if you choose to this evening or on July 15. But I would suggest that <br /> as speakers do proceed, if you wish to make a presentation and it is overlapping in a <br /> substantial way to the prior speaker, you might wish to simply indicate to us that you <br /> do agree with that prior speaker....(It isn't) necessary to repeat the same thing again. <br /> We win (be able to) hear from more people with varying views." <br /> Mayor Hartnett caned upon the members of the audience who had been sworn in <br /> earlier and wished to speak to this issue. <br /> Dr. Nancy Jewell Cross, CEO Clean Air Transport Systems, 800 Main Street, <br /> Redwood City, distributed a letter and advised she was "bringing to the Council's <br /> attention a consideration that if you adopt it, would mean the hearing on the merits of <br /> this project is premature." She stated "the preface to your consideration does not give <br /> you legal authority to approve the construction of the EA project. Namely the absence <br /> of any kind of notice, preparation of Environmental Impact Report or negative <br /> declaration or any kind of notice or extension therefrom. The fact that you may want <br /> to refer to some general document in 1975 that has no reference to Electronic Arts <br /> doesn't give you authority to proceed." Dr. Cross requested a copy of the notice <br /> specified in California Public Resources Code, Section 21092 including Initial Study if <br /> - any, and other documents as well. Dr. Cross discussed the inadequacies of the <br /> transportation studies, the necessity of compliance with the California Environmental <br /> Quality Act, the Clean Air Transport systems support of the appeal by the Coalition for <br /> Compatible Land Use, and certain jurisdictional questions. Dr. Cross suggested the <br /> "City Council should sustain the appeal and set-aside the Planning Commission's <br /> decision as void for lack of jurisdiction." <br /> Mayor Hartnett said "with respect to the jurisdiction issue we obviously don't share <br /> the position of the first speaker, and our City Attorney is satisfied that we have issued <br /> appropriate notices and have the jurisdiction required to make any decisions that are <br /> before us tonight or which will be before us on July 15." Mayor Hartnett asked the <br /> City Attorney "Is that correct?" City Attorney Shricker said "That is correct." <br /> Marcy Schultz, 29 Pelican Lane, Head of the Building and Construction Trades <br /> Council of San Mateo County which represents thousands of construction workers, and <br /> a resident of the Redwood Shores neighborhood of Redwood City said the Building <br /> Trades Council takes a very serious look at projects before publicly supporting them, <br /> looking for a quality project, making sure it fits in aesthetically with its surrounding <br /> areas, and most importantly ensuring it has a positive impact on the community.
