Vice Mayor Howard reported that the downtown "Climate Best Fest" held <br /> September 21 and 22 was a big success. She also reported that the "Coastal Clean- <br /> Up" held September 21 was another big success with approximately 75 volunteers <br /> who helped clean-up Redwood Creek. <br /> B. Mayor Hartnett announced that the Council had been invited to the "Unsung Hero" <br /> luncheon on Sunday, September 29, 1996 at the Elks Club and encouraged his <br /> coneagues and the public to attend. <br /> MEMO 9/24/96 <br /> -----------------------------------------------------------------------------------------------------------------____nn <br /> 8. STAFF REPORTS <br /> A USE PERMIT REVOCATION for the "Woodside Gas Mart" Service Station located at <br /> 895 Woodside Road. (604) <br /> REPORT: Acting Planning Director, September 23, 1996 <br /> Two Petitions submitted by Tim De Spain <br /> Acting Planning Director Jany summarized the subject report which provides background <br /> on the operations of the Woodside gas station through the years. Director Jany described <br /> the neighbor's complaints regarding the new 24-hour operation, an additional gas pump, <br /> glare from the new lights, open storage of trash, noise and traffic problems. He described <br /> the property owners/operators past refusal to abide by the provisions of their Use Permit <br /> and the citations issued by the City for violations of the Zoning Ordinance. Director Jany <br /> said the property owners/operators have refused to complete an application for a Use Permit <br /> that would anow a public hearing where an concerns could be addressed, and under Zoning <br /> Ordinance Sections 42.8 and 42.9 a Use Permit may be revoked if the Council deems that <br /> continuance of the Use Permit would be detrimental to the health, safety, morals, comfort <br /> and general welfare of the persons residing or working in the vicinity of such use. <br /> In response to Council questions, City Attorney Schricker stated that only the City <br /> Council could revoke a Use Permit, and he described the legal process for revocation <br /> proceedings. <br /> Mayor Hartnett advised that the Council was in receipt of a number of petitions from the <br /> neighbors of the subject Woodside gas station citing Use Permit violations and serious <br /> problems previously described by Director Jany. <br /> ADJOURNED REGULAR COUNCIL MEETING SEPTEMBER23,1996 <br /> MINUTES MINUTE BOOK NO. 54 PAGE 8 <br /> Page No. 503 <br />
