<br /> Chairman Bursak introduced his fenow Commissioners David Pine, Michael <br /> Verdone, Ralph Garcia and Roland Giannini. <br /> Mayor Hartnett thanked Chairman Bursak for the report and said the <br /> accomplishments of the Planning Commission were quite significant. Mayor Hartnett <br /> addressed the statement that the Port had limited its physical growth by accepting the <br /> Pacific Shores Project, stating that the Port does not own nor have any right to the land <br /> owned by the Pacific Shores Developers. Mayor Hartnett added that the Pacific Shores <br /> Project win expand Port land without cost to the Port or City. Mayor Hartnett said <br /> "with respect to the scope of the Planning Commission's review of that property that is <br /> east of the freeway up to the waterway at the end of Seaport Boulevard.... The Port <br /> area may be defined as a matter of law, that is very specific and under the Port <br /> jurisdiction." He said it was his understanding the Planning Commission's intent was <br /> to review a quite broader area than just the land within the Port's jurisdiction. Mayor <br /> Hartnett said that with respect to the Port itself, it was his understanding that "it is not <br /> your intent and you understand and it is not within the Planning Commission's <br /> jurisdiction to be reviewing the management of the Port and the specific Port profits, <br /> budgets and so forth. It simply isn't your intention to review those matters. Is that a <br /> fair statement?" <br /> Chairman Bursak said "I think I can assure you that that is probably the last think on <br /> any of our minds." In answer to Mayor Hartnett's further questions, Chairman Bursak <br /> said "I personally find myself criticizing the Port for factual material I read in the paper <br /> or I get in hand outs which lead me to be critical, but that has nothing to do with this. <br /> We are not planning to review what the Port does, that's your job..... I can't imagine <br /> how that would get on the agenda." <br /> Mayor Hartnett reaffirmed that it would not be on the Planning Commission's <br /> agenda because that kind of review is not within its jurisdiction. Mayor Hartnett asked <br /> for clarification and definition of the direction the Planning Commission intended to <br /> pursue in terms of the parameters of a review and the elements of a review, and said "it <br /> would be helpful to have that reported to the CounciL... for the Council to comment <br /> with respect to what the intended plan is in its specifics.... It is difficult for the Council <br /> to react to a WorkpIan as described as one that has a sense of wonderment." Mayor <br /> Hartnett further clarified Council's need for more information on the planned project <br /> by asking the Planning Commission for "a statement of intended direction by which <br /> you ask us for comments before you start going in that direction, so that we don't get a <br /> report in a year, half way through a process."
