The Commissions and Committees have <br /> - an ability within their jurisdiction to request certain things, but at certain points in time <br /> given the limits of the ability of staff to do all that it is asked at one time, ultimately it <br /> is the Council that needs to set the priorities in that regard." <br /> In response to Councilman Claire's questions regarding the Port and the Planning <br /> Commission's jurisdictions City Attorney Schricker said the Planning Commission <br /> does have zoning and general Planning jurisdiction over the privately owned lands. He <br /> added, "However, what is unique to the Port is that within the Port area as it is defined <br /> in the Charter, the Port has literally permitting authority which relates to the promotion <br /> of maritime commerce in that area. The Charter in a sense has designated a certain <br /> preference for maritime commerce in that area, but it is under discretion of the Port <br /> Commissioners, and that is a flexible term." <br /> Councilman Claire said the Charter gives the Port jurisdiction over "all the tributaries <br /> of Redwood Creek." City Attorney Schricker agreed adding "literally it is very <br /> extensive, but from a practical standpoint I don't think the Port is interested..... in <br /> exercising jurisdiction up to the Farm Hi!! Boulevard area where the Creek has a <br /> tributary..... In that context the maritime commerce side of the Port is related to <br /> navigable waterways." <br /> Councilman Claire said the question of jurisdiction has been confusing over the <br /> --- years, but the Port and the City have worked well together in respecting each other's <br /> areas of influence. Councilman Claire stated that the Planning Commission does not <br /> have jurisdiction over planning activities on Port property, but the City Attorney's <br /> memo to the Port Commission on this matter implies that although the Council cannot <br /> ten the Board of Port Commissioners how to run the Port, the Council does have the <br /> authority to remove the Port Commissioners. City Attorney Schricker said "That is <br /> correct. The Charter provides that the management which is basically a commercial <br /> and industrial business management over the Port properties is vested exclusively in <br /> the Board of Port Commissioners" but the Council has the authority to remove them <br /> from office. <br /> Vice Mayor Howard discussed the EIR for Franklin Street, and said the Housing and <br /> Human Concerns Committee would like to work with the Planning Commission on <br /> housing developments.
