(a) No building permit or certificate <br /> of occupancy shall be issued by the Building Official if the <br /> structure to be constructed or the portion to be remodeled <br /> lies within, or fails to have the necessary setback distance <br /> from, any area reserved for the construction, widening or <br /> extension of the Redwood City street system pursuant ta <br /> action taken by the Council of the City of Redwood City. <br /> " (b) No building permit or certificate of occupancy <br /> shall be issued by the Building Official if the structure <br /> to be constructed or the portion to be remodeled lies within <br /> � any recorded property interest held for public purposes or <br /> public utility purposes." <br /> SECTION 6. The Building Code is hereby amended by adding <br /> thereto following Section 308 a new section to be numbered 309, <br /> said section to read as follows: <br /> "Section 309. No final inspection shall be approved, <br /> nor shall any certificate of occupancy be issued, unless the <br /> � Building Official finds that the street, sidewalk, curb and <br /> gutter on or abutting the parcel for which a building permit <br /> was issued are clean, are in a state of good repair, and <br /> comply with the provisions of the Hedwood City Sidewalk and <br /> Driveway Ordinance." <br /> SECTION 7 .
