�..�...� <br /> �ECTION 8. Tie Bids. In the event two or more bids <br /> rece ived are for the same total amount or unit price, fitness, <br /> quality and all other factors being equal, preference shall be <br /> given to local bidders; otherwise, the order of preference shall <br /> be determined by the drawing of lots. <br /> SECTION 9. Performance Bonds. The public notice inviting <br /> bids may prescribe that the successful bidder shall furnish a <br /> performance bond in such amount as the City Manager may find <br /> reasonably necessary to protect the best interests of the City. <br /> Such bond shall be executed by a corporate surety autharized to <br /> do business in the State of California which is acceptab le to <br /> the City Manager. <br /> SECTION 10. Execution of Contracts. Al1 purchase contracts <br /> entered into by the City having cost in excess of Two Thousand <br /> Dollars ($2,000.00) , and all contracts for the performing of any <br /> pub lic work or improvement costing more than Two Thousand Dollars <br /> ($2,000.00) , shall be in writing and shall be executed by the <br /> City Manager. <br /> SECTION 11. Subdivision Prohibited. No contract or purchase <br /> shall be subdivided to avoid the requirements of this ordinance . <br /> SECTION 12. Special Improvement Proceedinqs. Whenever any <br /> public work or i.mprovement is to be constructed pursuant to any <br /> improvement ordinance or State Improvement Act, bidding procedures <br /> provided for therein shall control over any inconsistent provisions <br /> of this ordinance. <br /> �ECTION 13. Personal Services. Notwithstanding any provision <br /> in this ordinance to the contrary, the City Council may contract <br /> for personal services, including expert personal services of an <br /> engineering, appraisal, right of way acquisition, legal, or <br /> -4- <br />
