Close public hearing; <br /> MIS: STEINFELDIBUCHÀN TO èLOSE THE PUBLIC HEARING. <br /> CARRIED BY UNANIMOUS VOICE VOTE. <br /> In response to a question from Councilman Sanfilipo, City Attorney Schricker <br /> stated that the Council has the authority to remand the matter to the Zoning <br /> Administrator for the purpose of submitting recommendations. <br /> Planning Director Patterson, stated that since it has been established that the owner <br /> wants to operate until 1 :30 a.m. it would be difficult to find a workable alternative for <br /> the Zoning Administrator. <br /> In response to a question from Councilman Sanfilipo, Tom Barger General Manager <br /> of Mel's Bowl stated that the bar at Mel's Bowl stays open until 11:00 during the <br /> week, Thursday until midnight and Friday and Saturday until 1 :00 am but they do not <br /> have any dancing at the location. <br /> Councilwoman Steinfeld discussed the possibility of extending the restaurant hours <br /> until 10:00 p.m. Planning Director Patterson stated that the owner did not request <br /> extending the restaurant hours the request was to extend the hours for dancing. <br /> City Attorney Schricker recommended against refashioning the application because <br /> the applicant bears the burden of presenting the full case to the Zoning Administrator. <br /> 5. Council action; <br /> MIS: BUCHANISTEINFELD TO UPHOLD THE ZONING <br /> ADMINISTRATOR'S DECISION AND DENY THE APPEAL. <br /> Councilwoman Buchan expressed her support to the staff during this process. The <br /> findings put forth by the Zoning Administrator characterize both the concerns of the <br /> neighborhood and the Council. Granting the appeal would be turning back the clock. <br /> The Appellant may want to contribute to the neighborhood but the use proposed will <br /> not do that. She further noted that if anyone wants to be on the mailing list for their <br /> neighborhood association meetings they should call the City Manager's office. <br /> Vice Mayor Hartnett emphasized the importance of sending the right message. He <br /> stressed the importance of good communication between the proprietor and the <br /> neighbors at the initial stage of the process, presenting the full application in the <br /> beginning of the process and the fact that the Zoning Administrator is in not in a <br /> position to negotiate the process.
