Io.A-6 <br /> <br />exclusion of municipal zoning, building and fire codes and regulations governing the use <br />or occupancy of family day care homes for children, except as specifically provided for <br />in this chapter, and to prohibit any restrictions relating to the use of single-family <br />residences for family day care homes for children except as provided by this chapter. <br />State law further provides: Under "Findings and Declarations": The Legislature finds <br />and declares all of the following: Family day care homes operated under the standards <br />of State law constitute accessory uses of residentially zoned and occupied properties <br />and do not fundamentally alter the nature of the underlying residential uses. Family day <br />care homes draw clients and vehicles to their sites during a limited time of day and do <br />not require the attendance of a large number of employees and equipment. <br /> <br />The State law pertaining to the option that a municipality has to regulate large family <br />day care homes provides in part that a city, county, or city and county shall no~t prohibit <br />large family day care homes on lots zoned for single-family dwellings, but shall do one <br />of the following: (1) Classify these homes as a permitted use of residential property for <br />zoning purposes; or (2) Grant a nondiscretionary permit to use a lot zoned for a single- <br />family dwelling; or (3) Require any large family day care home to apply for a permit to <br />use a lot zoned for single-family dwellings. The ordinance adopted by Redwood City <br />follows option No. (2). Under said option, State Law provides that a municipality shall <br />grant a nondiscretionary permit to use a lot zoned for a single-family dwelling or to any <br />large family day care home that complies with local ordinances prescribing reasonable <br />standards, restrictions, and requirements concerning spacing and concentration, traffic <br />control, parking, and noise control relating to such homes, and complies with certain <br />requirements adopted by the State Fire Marshal. Any noise standards shall be <br />consistent with local noise ordinances implementing the noise element of the general <br />plan and shall take into consideration the noise level generated by children. <br /> <br />Redwood City's evaluation criteria for large family day care homes <br />The following are the eight criteria for evaluation of a large family day care home listed <br />on the Redwood City Permit Application for a Large day care home and the ways in <br />which the applicant meets the criteria. The criteria was prepared by the Planning <br />Division and is based upon State law and the Redwood City Zoning Ordinance. <br /> <br /> 1. The provider has secured a large family day care home license from the State of <br /> California, Department of Social Services. The applicant shall provide proof of <br /> such license to the Planning and Redevelopment Division. (California Health & <br /> Safety Code, Section 1597.46, large family day care homes) <br /> <br /> The applicant obtained a license for a large family day care home from the <br /> State of California, Department of Social Services on November 27, 2001. <br /> Proof of license was submitted to the Redwood City Planning Division <br /> December 10, 2001. <br /> <br /> 2. The facility is the residence of the provider and the use is cleady incidental and <br /> secondary to the use of the property for residential purposes.
