Council Member Seybert asked Dr. Bell to break out the costs of operations and maintenance of the Marina. Dr. Bell indicated that most of the cumulative cost is to pay for staff time to manage the Marina, approximately 700 hours a month. Some other costs included in the $1.5 million include one-time costs, such as removal of the barge. He noted that this is after the revenue from the agreement. Council Member Seybert asked if the $195,000 is the annual net cost to the City and Dr. Bell replied that is correct. Vice Mayor Foust noted that the City Manager has been able to successfully negotiate agreements with 82 out of the 87 current tenants. Dr. Bell replied there are a handful of tenants that are still working on their agreements. Vice Mayor Foust thanked the individuals who have signed their agreements and worked with the City successfully. She asked if the City has legal recourse for what the City had to do for pocktown that the manager was not taking care of, in order to protect the residents. City Attorney Thompson stated that staff can look into it but it would be a challenge. Dr. Bell noted that the majority of people signed their agreements and worked with the City to compromise on an agreement that would benefit the residents and the City. Vice Mayor Foust asked Dr. Bell to expand on what types of records the City inherited. Dr. Bell stated that there were some agreements that were submitted to the City, but there were not records for every berth and resident. Council Member Bain asked about the communications from State Lands Commission. Dr. Bell stated these are the staff s statements about what their long-term policies are. Council Member Bain asked if staff is aware of the Commission making a particular decision on this issue. Dr. Bell stated that the Commission has not set a definite timeline for the City to come into compliance with the Public Trust doctrine. Council Member Bain asked if there is information on how the Commission would enforce that policy. Dr. Bell replied that there is a process that the Commission has used to have other cities fall into compliance, but to their knowledge there is no written policy in existence. Public Comment Kevin Germano stated that Docktown Marina has been in existence since 1954. He stated that he and the other residents should be able to stay at their homes, noting that Sausalito and other communities were grandfathered in. Alison Madden noted that the Commission meeting is broadcast on CalSpan and that Dr. Bell was referring to the Executive Director of staff, not the Director, and that the Chair said to instruct Redwood City that the Commission has not acted yet. She opined that the Commission needs to act and referred to 2CCR, section 2002 regarding leasing in a Marina. She noted that there were statements in the 1993 Pete's Harbor legislation that specifically said that the use in the outer harbor was consistent with the public trust. She noted that houseboats are not the same thing as liveaboards. She noted that the initial capital expenditures included a very expensive harbormaster.
