<br /> Don Warren, representing Redwood Shores Properties, owner of the Egret Lane <br /> property and the reversionary interest in the Sandpiper Park properties deeded to the <br /> City for park purposes, expressed his support for the joint project, but expressed his <br /> concerns regarding some factors that still needed to be resolved. Mr. Warren <br /> assured the Council that Redwood Shores Properties was fully behind this joint <br /> project. <br /> Bruce Russell, of Russell, Russell and Patton, attorney representing Redwood <br /> Shores Properties, asked that the record show Redwood Shores Properties had <br /> concerns regarding the following points which he raised as procedural objections: <br /> Apportionment. Mr. Russell stated that although the fee interest of the Egret Lane <br /> property belonged to Redwood Shores Properties they had no control over the <br /> CC&Rs, and the offer should have been apportioned between the fee interest and the <br /> CC&Rs. <br /> Methodology for assessment of reversionary interests. Mr. Russell stated that the <br /> proposed joint use development of the properties had made revocation of the <br /> reversionary clauses regarding the Sandpiper Park Parcels worth more than the $100 <br /> the City had offered. <br /> Summary of all separate interests. Mr. Russell stated that the summaries of the <br /> basis for the valuations of the above interests should have been separately stated in <br /> accordance with the above objections. <br /> City Attorney Schricker advised that all of the City's actions had been appropriate <br /> and consistent with eminent domain law, including the summaries of the basis for <br /> valuation, and that apportionment involved competing private interests, not <br /> valuation of the property to be acquired by the City.. <br /> Mayor Gasparini called on those who wished to speak to the Council on this issue. <br /> Jim Sjoerdsma, 863 Columbia Circle, Redwood City, urged the Council to approve <br /> this project. <br />4.
