Petition signed by 116 neighbors of Taco Bell, 910 Woodside Road <br /> All speakers who intended to give testimony/evidence in the matter before <br /> the Council arose, raised their right hands and in response to the oath <br /> promising to tell the truth administered by the City Clerk, all answered in <br /> the affirmative. <br /> MEMO 11/2/93 <br /> Acting Planning Director Jany introduced Mr. Tim Despain and Mr. Carl <br /> Dresden who narrated a 10-minute video showing many young people loitering <br /> in the parking lot of the Taco Bell at 910 Woodside Road, exhibiting <br /> destructive, disruptive, noisy and alleged criminal behavior of drug dealing <br /> and knife-wielding, as well as attempts at intimidation, that took place <br /> during the last part of June and early July of this year. <br /> Director Jany described the series of complaints by neighbors over the <br /> months and the initial inaction and recent action taken by Taco Bell and its <br /> employees that led to the staff recommendation to impose conditions on the <br /> Use Permit. In response to Council questions, Director Jany advised that <br /> staff and the neighbors had been working with Taco Bell, and, although, <br /> staff had expected better results from Taco Bell's efforts, staff was <br /> willing to keep working with all the parties if the Council chose to impose <br /> conditions on the Use Permit rather than revocation. <br /> In response to questions from City Attorney Schricker, Mr. Despain advised <br /> that although the problems at 910 Woodside had subsided somewhat since the <br /> City started revocation proceedings, the activity was still unacceptable. <br /> Mayor Buchan opened the Public Hearing at 8:26 P.M. and called on the people <br /> who had submitted speaker's cards. <br /> MINUTE ORDER NO. 93-217 <br /> Marty Orlick, Tobin & Tobin, attorney representing Taco Bell Corporation in <br /> the Bay Area, advised the Council that Taco Bell does want to be a good <br /> neighbor and activity as seen on the video would not be tolerated. Mr. <br /> Orlick described in detail the measures Taco Bell had taken to eliminate the <br /> unwanted activities, including: reduced operating hours; the hiring of a <br /> security guard, and their attempts to hire an off-duty police officer; <br /> security cameras; chaining the parking lot when the restaurant was closed; <br /> forbidding deliveries before 7:00 A.M.; modifying the lighting system; <br /> increasing the height on a neighbor's fence; new paint; and cleaning up <br /> litter within a 200 feet radius of the restaurant. Mr. Orlick stated that <br /> Taco Bell has made a commitment to resolve the problems at 910 Woodside Road <br /> and to be a good neighbor. <br /> The following employees of Taco Bell described their efforts to resolve the <br /> problems at 910 Woodside Road, and asked for a chance to work with staff and <br /> the neighbors to provide a safe, comfortable environment; <br /> Regular Meeting Minutes <br /> November 1, 1993 MINUTE BOOK NO. 52 <br /> Page 4 Page No. 31 <br />... .-"". ...". <br />
