ATTACHMENT 1 <br /> 7.B. - Page 145 <br /> WHEREAS, the City has agreed to incorporate in the Project all applicable <br /> mitigation measures identified in the IS/MND and the associated MMRP to reduce <br /> environmental impacts to less than significant levels; and <br /> WHEREAS, the Planning Commission has reviewed the Project's plans and all <br /> environmental documents and supporting studies and reports necessary for <br /> recommending adoption of the IS/MND and recommending approval of the Project <br /> design; and has considered the foregoing at a duly noticed public hearing on October 15, <br /> 2013; and <br /> WHEREAS, by this resolution, the City, as the lead agency under CEQA, desires <br /> to comply with the requirements of CEQA, the CEQA Guidelines, the applicable <br /> provisions of the California Government Code, and the applicable provisions of the City's <br /> Zoning Ordinance and Municipal Code, in connection with the approval and subsequent <br /> implementation of the Project. <br /> NOW THEREFORE, BE IT RESOLVED BY THE PLANNNG COMMISSION <br /> OF THE CITY OF REDWOOD CITY, AS FOLLOWS: <br /> A. The IS/MND (attached hereto as Exhibit A) and the associated MMRP <br /> (attached hereto as Exhibit B)are hereby recommended for adoption by the City Council <br /> based on the following findings: <br /> 1. The above recitals are true and correct and together with the Staff <br /> Report and the application materials, including without limitation the IS/MND and all other <br /> documents, reports, studies, memoranda, maps,oral and written testimony,and materials <br /> in the City's file for the application and the Project, and all adopted City planning <br /> documents relating to the U.S. Highway 101 Pedestrian Undercrossing and Bair Island <br /> Road Storm Drain Pump Station Project and the property including the City's General <br /> Plan, Zoning Ordinance, and other applicable City laws and regulations and associated <br /> approved and certified environmental documents, have together served as an adequate <br /> and appropriate evidentiary basis for the findings and actions set forth in this Resolution. <br /> 2. The City of Redwood City is the lead agency under the California <br /> Environmental Quality Act (CEQA) for preparing the IS/MND, and the City Council is the <br /> entity with final decision-making authority with regard to approval of the U.S. Highway <br /> 101 Pedestrian Undercrossing and Bair Island Road Storm Drain Pump Station Project. <br /> 3. The Planning Commission finds that the IS/MND for the Project was <br /> presented to the Planning Commission, that the IS/MND was prepared, published, <br /> circulated, reviewed and completed in full compliance with State law and CEQA <br /> Guidelines, that there was adequate public review of the IS/MND, that it has considered <br /> the IS/MND and all comments on the IS/MND, that the IS/MND adequately discusses all <br /> significant environmental issues, and that the IS/MND reflects the independent judgment <br /> and analysis of the Planning Commission and the City of Redwood City. <br /> ATTY/RESO.2920/PC RESO-ADOPT THE INITIAL STUDY&MND—UNDERCROSSING <br /> REV:10-10-13 VR <br /> Page 2 of 6 <br />
