04/25/2016 <br /> WHEREAS, the City has agreed to incorporate in the Project all applicable <br /> mitigation measures identified in the IS/MND and the associated MMRP to reduce <br /> environmental impacts to less than significant levels; and <br /> WHEREAS, the Planning Commission considered the Project's plans and <br /> all environmental documents and supporting studies and reports necessary for <br /> recommending adoption of the IS/MND; by Resolution No. 13-24 the Planning <br /> Commission recommended that the City Council adopt the IS/MND and the MMRP <br /> and approve the Project design; and considered the foregoing at a duly noticed <br /> public hearing on October 15, 2013; and <br /> WHEREAS, the City constructed the storm d"rain pump station on Bair Island <br /> Road relying on a CEQA exemption and now proposed to construct the joint-use <br /> pedestrian and bicycle path under the U.S. Highway 101 freeway (the <br /> "Undercrossing Project"); and <br /> WHEREAS, an Addendum to the Initial Study and Mitigated Negative <br /> Declaration was prepared in April 2016 documenting changes to the Project, <br /> analyzing the effects of new regulations, identifying nearby projects that were not <br /> in place when the IS/MND was prepared and confirming that the IS/MND <br /> constitutes an adequate, accurate, objective, and complete review of the <br /> environmental effects of the Undercrossing Project ("Addendum") and the <br /> Addendum found that there was no new significant environmental effect; and <br /> WHEREAS, the City Council considered the Undercrossing Project's plans <br /> and all environmental documents and supporting studies and reports necessary <br /> for adoption of the IS/MND; considered the Planning Commission's <br /> recommendations as established in Resolution No. 13-24; and considered the <br /> foregoing at a duly noticed public hearing on April 25, 2016. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF REDWOOD CITY, AS FOLLOWS: <br /> A. The IS/MND (attached hereto as Exhibit A) and the associated MMRP <br /> (attached hereto as Exhibit B) are hereby adopted by the City Council based on the <br /> following findings and upon consideration of the Addendum, which was prepared <br /> in accordance with all legal requirements, including CEQA: <br /> 1. The above recitals are true and correct and together with the <br /> Staff Report and the application materials, including without limitation the IS/MND, <br /> its Addendum, and all other documents, reports, studies, memoranda, maps, oral <br /> and written testimony, and materials in the City's file for the application and the <br /> Undercrossing Project, and all adopted City planning documents relating to <br /> Undercrossing Project and the property including the City's General Plan, Zoning <br /> Ordinance, and other applicable City laws and regulations and associated <br /> approved and certified environmental documents, have together served as an <br /> adequate and appropriate evidentiary basis for the findings and actions set forth <br /> in this Resolution. <br /> ATTY/RE50.0032/CC RESO US 101 UNDRCROSSING PROJECT RESO#15488 <br /> REV:04-21-16 VR MUFF#613 <br /> Page 2 of 3 <br />
