Callback — Whenever, in the opinion of the City, a section of street is <br />inadequately swept, the Contractor shall, within 24 hours after notification, <br />re -sweep the section in question and agrees to pay, at the discretion of the <br />City, liquidated damages of one hundred dollars ($100) for each time a <br />street is inadequately swept. No additional payment by the City will be <br />made for callbacks as a result of inadequate sweeping. <br />Weather — In the event of heavy rain or other severe weather conditions, <br />the scheduled sweeping service may be suspended. The decision to sweep <br />will be made by the City. The Contractor shall contact the Public Works <br />Superintendent or Public Works Supervisor to determine if sweeping has <br />been suspended. <br />k. Water — City will provide Contractor with water necessary for street <br />sweeping. Water may be obtained from the potable hydrant located in the <br />Public Works Corporation Yard. Should the Contractor need to obtain water <br />from additional hydrants within the City, the Contractor must apply for a <br />construction meter at City Hall. The Contractor will be responsible for paying <br />the deposit fee and monthly meter service charges. Contractor must use a <br />City construction meter to fill from a hydrant within the City. <br />III. Equipment <br />The equipment used to complete street sweeping required by this contract is subject <br />to the approval of the City, and Contractor must be in possession of equipment <br />capable of being able to remove a variety of material that can be found on streets (e.g. <br />leaves, glass, gravel, dirt, mud, etc.) <br />a. Equipment Breakdowns — Contractor shall properly maintain, at all times, a <br />fleet of sweeping equipment both as to condition and appearance for the <br />use on the work under this Agreement. Contractor shall have multiple spare <br />sweepers on hand in the event of a breakdown by the primary sweeper. In <br />case of breakdown by the main sweeper, immediate service within one hour <br />by a second sweeper is required to complete the daily schedule. If down <br />for more than one hour, Contractor agrees to pay as liquidated damages of <br />fifty dollars ($50.00) per hour for each hour above and beyond one hour. <br />b. Equipment Condition — Contractor's equipment must be in good working <br />condition, capable of removing dirt, rocks, glass, mud, cans, sticks, leaves, <br />street debris throughout the life of the contract. The outside body must be <br />free from dents and large scratches, and paint must be well maintained. <br />All sweeping equipment must not be over seven (7) years old at the time of <br />bid and for the duration of the contract. <br />Equipment must be equipped with dual gutter brooms not shorter than <br />seven (7) inches, which shall be operating during all sweeping operations, <br />and a main broom not shorter than eight (8) inches capable of sweeping at <br />minimum an eight (8) foot path, or vacuum sweep if approved by the Public <br />REV: 05-12-2021 MI <br />ATTY/AGR.2021/Amend.
