<br /> Control District to administer the NPDES program. Councilman Greenalch <br /> advised that the Lido project was deemed consistent with the ALUC by CCAG, <br /> and advised that additional CCAG staffing would be necessary in the future. <br /> Councilman Greenalch stated that CCAG was gaining importance and authority <br /> in our community and the Council must continue to be active in its policy <br /> decisions. <br /> ---------------------------------------------------------------------------------- <br /> 8. STAFF REPORTS <br /> A. Consideration of Ordinance relating to interference with access to any <br /> lawful business and access to health care facilities (First reading on <br /> May 24, 1993.) <br /> Mayor Buchan introduced this item, described the previous discussion on <br /> May 24th and invited anyone who wished to speak to please come forward. The <br /> first speakers were those who submitted speaker's cards: <br /> Catherine Short, Napa, California, spoke in opposition to the proposed <br /> ordinance stating it was overly broad, allowed anyone to create a "bubble", <br /> even employees of the health facility, and it punishes people who are "not <br /> doing anything." Ms. Short referred to the wording of the proposed <br /> ordinance (Section 11.11) "Demonstration Activity - means all expressive and <br /> symbolic conduct, whether active or passive..." as being overly broad, <br /> inappropriate and denying equal justice to protesters. Ms. Short advised <br /> that implementation of the proposed ordinance would create a "civil cause of <br /> action." <br /> Councilman Greenalch explained that this ordinance is intended to preclude <br /> harassment, intimidation and impeding access to health care facilities. If <br /> a person is just standing there and not doing any of those things, he or she <br /> will not be affected. Councilman Greenalch advised the word "passive" in <br /> Section 11.11 must be interpreted in the wider context. <br /> City Attorney Schricker advised that the proposed ordinance addresses the <br /> conduct of impeding access to any health care facility in Redwood City and <br /> the right to ask someone who is impeding that access to withdraw eight (8) <br /> feet. Mr. Schricker advised that the way to test this ordinance is to put <br /> it into effect and let the courts decide. Mr. Schricker described the <br /> proposed ordinance as practical, and a specific response to specific <br /> activities in Redwood City. <br /> Mayor Buchan asked if anyone else who opposed this ordinance would like to <br /> speak at this time. No one came forward. <br /> The following people spoke in favor of the ordinance: <br /> Dr. Alex Peros, neighbor of Planned Parenthood in Redwood City, described <br /> the vandalism, and other illegal and obnoxious actions of certain <br /> protesters; and, asked Council to enact an ordinance prohibiting <br /> demonstrations within 1,000 feet of a health facility if that facility is in <br /> a residential district; <br /> MINUTE BOOK NO. 51 Regular Meeting Minutes <br /> June 14, 1993 <br /> Page No. 436 Page 5 <br />
