1291 Gentlemen: As we notified you orally last week, it is with a great deal of relectance and after considerable thought that we find it necessary to submit our resignation as City Attorney for the City of Redwood City. This resignation may be accepted at the will of the Council, but in no event later than September 1, 1956. Our decision in this is definite and final: however, in no event do we which to leave the City in an embarrassing position insofar as legal counsel is concerned, and we will cooperate to the fullest in taking care of the City's legal problems until our successor is named. Pon It should be pointed out at this time that it has been a truly great pleasure to work with the City Council and all department heads during the nearly nine years that we have how acted as City Attorney. There is absolutely no reason for our resignation other than that both Mr. Lebsack and I feel a strong obligation to our familes, which has been seriously inter- fered with and would undoubtedly be more severly affected as the legal problems of Redwood City increase. We regret very much that the City work has increased to such a point that we have been forced to make a decision as to whether both of us should be full time City Attorneys or continue in private practice. It is our combined recommendation that the City of Redwood City employ a full time City Attorney and possibly a part-time assistant to this man. Such a full time City Attorney should be well grounded in municipal law, and it is our feeling that considerable thought should be given as to who this person should be. Nhile this undoubtedly will increase the cost of the operation of the City Attorney's department, it is fet that the size of Rectwood City and the many problems presented warrant an outstanding legal advisor, and in the long run it actually would result in a grat saving to the City. We will complete, if the Council so desires, all work pertaining to the following itemss (1) Acquisition of all lands necessary for the construction of parking lots in Parking llistrict No. 1. (2) All litigation, including the pending two suits in the Superior Court and the one on arlpeal dealing with the truck route ordinance. (3) All annexations commenced during our tenure of office. (4) All assessment proceedings already commenced or which will be commenced prior to our final.termination of employment. (5) All condemnationactions now pending. We would be glad, if the Council so desires, to assist the person selected by you -as City Attorney in all matters. In addition, if the Council wishes to employ us on a fee basis, we would be willingto handle actions in eminent domain im rovemtn , p proceedings, and consult on any special matters. irw Again, we would like to state that the decision to resign has been made only after long and careful evaluation of the matter, and our relationship with the Council and the department heads and employees of the City has been most pleasant, and we shoi;ld personally like to thank each and every one for the many kindnesses, consideration and helpful suggestions which we have always reveived from everyone in the City. The Clerk read the following letter of resignation from Leonard Joesten: "Due to the press of personal affairs, I regret that I must submit my resignation from the Planning Commission of the City of Redwood City, effective May 15, 1956. It has been a privilege and a pleasure to have served the people of Re&rood City for the past six years." Councilman Stout moved acceptance of the resignation and offered the thanks of the Council for his untiring i_m work for the City, seconded by Councilman Weiss and carried. 6.r RESOLUTION CALLING FOR BIDS, POPLAR, HESS AND E13ENER BONDS. Councilman Granger offered RESOLUTION 2021 DIRECTING SALE OF IMPROVEMENT BONDS, POPLAR-HESS-EBENER AREA IMPROVERTAENTS and moved its adoption, seconded by Council- man Herkner and carried on roll call. DIVISION OF HIGITWAYS REQUEST CANCELLATION OF TAXES ON THREE PARCELS. Councilman Stout moved approval of the request, seconded by Councilman Spillers and carried.- CITY MANAGER RECOMMENDATION REGARDING LIGHTING BAYSHORF FREE!JVAY OVERPASSES. In his report, the City Manager stated that the State Division of Highways requested that the City assume the total cost of operation and maintenance of six only 11,000 lumen mercury vapor electroliers at the Whipple Avenue overpass, and six only 20,000 lumen mercury vapor electroliers at the Spruce Street overpass, The original installation will be made at the expense of the State Highway Department.
