1 4 <br />by discussion in regard to the six cylinder compressor. Councilman Britschgi offered an amendment to the <br />motion to accept the lowest bid which met the specifications. This lost for lack of a second and the <br />original motion awarding the.bid to Edward R. Bacon Company carried with Councilman Britschgi voting NO. <br />There was discussion in regard to granting bids when they are not the lowest bid. <br />COUNCILMAN HERKNER REPORT IN REFERENCE TO FUTURE CITY ATTORNEY. Councilman Herkner reported that he and <br />Councilman Granger met with the City Attorney and his assistant in regard to hiring a new City Attorney. <br />It is estimated that they can hire a competent attorney for the cost of the present attorney with the <br />exception of capital outlay for a library and office equipment.. It was the consensus of the Committee <br />that the City should hire a full time attorney and they recommend that this be done. They also recommend <br />authorizing the City Manager to advertise for candidates and then, together with the Committee, to <br />report and screen them down to three, and, after the three condidates have been selected, they be pre- <br />sented to the Council for approval and selection of one. The Committee further suggested that the <br />Committee consist of two Councilmen, the City Manager, the City Attorney and a member of the Personnel <br />Board. Councilman Herkner moved to follow through on the Committee's recommendations and suggestions, <br />seconded by Councilman Granger. Councilman Weiss read a report on his views in regard to the selection <br />of a future City Attorney. <br />At the study meeting when this matter was first discussed I stated that it was my <br />thought and belief that when and if the time arrives for the appointment of a full time <br />City Attorney, the proposal of the committee to make such a selection and recommendation <br />should include at least one of the Judges of our Superior Courts as well as an Attorney who <br />is not an applicant selected by the San Mateo County Bar Association. <br />Since that time I have given the matter further thought, and my views have not <br />changed to any great degree, I still believe. that if we are to obtain a properly qualified <br />individual willing to serve at salary stipulated or that may hereafter be stipulated, <br />we must exercise the greatest possible care and obtain whatever competent professional <br />assestance we can get. <br />I agree that the City Manager should solicit applications, all application received <br />should be held confidential as sanstioned by the Brown Act and by him turned over to a <br />eons ttee comprised of at least one Judge of the Superior Court, one of the officers of <br />the San Mateo County Bar Assn. and of the Legal Profession, and one other person of the <br />Legal Profession chosen by the aforementioned. Said committee should screen the applica- <br />tions and/or applicants so that they may eliminate all but three whose names shall then <br />be submitted to the dommi.ttee recommended by Councilman Herkner. Said committee shall <br />screen and interview the three finalists and submit their names to the council for final <br />consideration with their recommendation as to who shall be given top priority, second and <br />third respectively. The entire proceedings shall be held confidential at all times as <br />sanctioned by the Brown Act to avoid embarassment either to the applicants or those <br />serving and assisting in the selection of the individual who is finally to be tendered <br />an appointment. <br />I have also given the matter of compensation some study. It is my belief that the <br />city is entitled to the highest possible type of legal service commensurate with our <br />ability to finance. It is my belief that unless we set a salary of at least $10,000 <br />per annum for the position, we can not hope to obtain the sercies of one with proper <br />qualifications, and especially one with sufficient experience in municipal and govern- <br />mental law. As a further incentive to retain the services of a qualified individual <br />after appointment, we should make provisions for an increse in such compensation based on <br />length of service; say 5% every three years of satisfactory service, with a maximum <br />of 25% after 15 years. <br />77 <br />Councilman Weiss moved to substitute motion and the first committee to screen the applicants. This � <br />lost for lack of a second. Councilman Stout suggest a source of information be the League of California Mai <br />Cities. The original motion carried, Councilman Weiss voting NO. <br />Councilman Herkner stated that he thought some of Councilman Weiss's suggestions could be followed <br />through and he thought that having a Judge on the Committee might be a good idea. This was followed <br />W" <br />by discussion. The Mayor stated that the Committee could get any help that they may need, and he <br />named the Committee, Councilmen Herkner and Granger, the City Attorney, the City Manager and the chairma ..� <br />of the Personnel Board. <br />CITY ATTORNEY REGARDING HIGHLANDS TERRITORY NO. 1 SEIVER AND 11VATER I14PROVEMENTS, NEW RESOLUTION OF PR+LIMINARY <br />DETERMINATION. The Mayor announced that the City Attorney had ruled that, because of changes as suggest- <br />ed at the last Council meeting, the Council would have to start the proceeding all over again.
