Mt* Stuarts proposed 30 unit apartment building. <br />Councilman Weiss moved that the original action be allowed to stand, the public hearing as set forth by <br />the Planning Commission be continuted, seconded by Councilman Granger. This was again followed by a <br />very lengthy discussion after which the motion carried. <br />PUBLIC HEARING, PLANNING COMMISSION'S RECOMMENDATION APPROVING INITIATIVE OF PLANNING COMMISSION TO REZONE <br />HIGHLANDS OF EMERALD LAKE AND OAK KNOLL MANOR FROM "U" TO R-1 DISTRICT, EXCEPTING THAT AREA NOW ZONED MI <br />C -1-H DISTRICT. The Planning Commission held lengthy discussion on the subject and feel that this area ,,ow <br />can be developed as 6,000 sq. ft. lots if some method of setting up a road pattern can be devised. There <br />were no protests, written or oral. Councilman Weiss wanted to know if the map was available showing the <br />0-1-H District. City Engineer Jain was of the opinion that the part colored yellow on the map submitted <br />by the Planning Commission was the C -1-H District. Councilman Stout asked that the minutes show that the <br />map is filed in the City Clerk's office. Councilman Stout moved that the public hearing be closed, <br />seconded by Councilman Herkner and carried. <br />City Attorney Currie asked the Council to have the City Engineer prepare a description so that an <br />ordinance can be drawn up. Councilman Stout moved that the City Engineer draw up the description and <br />turn it over tothe City Attorney within one month.. seconded by Councilman Weiss and carried. <br />PUBLIC HEARING, ABE JACOBS APPEAL REGARDING CONDITION OF SIDEVdALK FRONTING 2626-2630 BROADWAY. The Clerk <br />read the letter he had been instructed to write to Mr. Jacobs telling him that his letter had been <br />accepted as an appeal and the date of hearing was May 28th, Mr. Jacobs spoke on the subject and stated <br />that he was not the only one who was involved and there were a number of spots in the block where the <br />sidewalk was sinking. This was followed by discussion as to when the original sidewalks were put in, <br />when the electroliers were installed, whether or not the curb was considered a part of the sidewalk and <br />whether or not the City was liable. <br />Mayor Royer asked to have two members of the Council meet with Mr. Jacobs's group and the City Engineer. wr <br />This was followed by considerable discussion after which Councilman Herkner moved that the public <br />hearing be continuted and in the meantime that the Mayor appoint a committee for a report in two weeks, <br />seconded by Councilman Stout, and carried. The Mayor appointed Caouniclmen Herkner and Stout and City <br />Engineer Jain to meet with Mr. Jacobs. <br />REPORT, PROPOSED EXTENSION FRANKLIN STREET, COUNTILMAN GRANGER. The Clerk read the following report sub- <br />mitted by Councilmen Granger and Britschgi and Assitant City Attorney Chester Lebsack who -met to' <br />consider the most recent proposal.of.the Southern Pacific Company forwarded to the Cituncil with their <br />letter April 13, 1956. <br />Inasmuch as the proposal for the extension of Franklin Street received from the Southern <br />Pacific Company on April 13, 1956 (more than fourteen months after the City orginal proposal) <br />does not comply with what was orignially proposed, particularly with regard to providing <br />substitute parking area if the existing area is used for other than off-site parking, the <br />Committee recommends as follows: <br />1. That the easement submitted by the Southern Pacific Company not be accepted <br />with the conditions contained therein. <br />2. That in the event the original proposal as stipulated by the City's letter of <br />February 15, 1955 is not carried out within -thirty (30) days from May 28, 1956, <br />the Planning Commission should be asked to re -institute hearings for the <br />ultimate desired zoning of the area in question. <br />3. That the Southern Pacific Company be'notified of any action by the Council with <br />regard to this report. <br />Councilman Stout moved approval of the Committee's report, the report be filed, and that the Southern " <br />Pacific Company be so notified, seconded by Councilman Granger. Councilman Herkner wanted to learn just <br />what the area of disagreement covered. Councilman Granger stated that there were parts of the agree- <br />ment that the Southern Pacific Company wanted to waive and the Committee did not feel that it should <br />be done. Councilman Herkner stated that he understood that Franklin Street would be cut through to <br />
