The five interested property mvners will guarantee to advance <br />the amount of the engineering expenses incurred to date, plus the costs of advertising for bids. This <br />guarantee is made to expedite the advertising for bids. <br />This was followed by discussion after which Councilman Herkner moved that the City Attorney be instructed <br />to call for bids in accordance with the plans made by the City Engineer, seconded by Councilman Spillers <br />and carried. <br />PUBLIC HEARING, HIGHLANDS OF EMERALD LAKE NO. 1, SEWER AND WATER IMPROVEPENTS. Affidavit of publication and "di <br />posting were ordered filed. Mrs. Margory Thirkell, 3516 Glenwood Avenue, Mr. Miller, Harding Avenue, <br />Donald Thirkell, 3516 Glenwood Avenue, Lowell Brown, 3626 Glenwood Avenue, Ms. McCarthy, 3509 Glenwood <br />Avenue, Mrs. Ruhl, 600.block Upton Street, Bob Chambers, 3622 Glenwood Avenue, Danny Silva, 3517 Glenwood <br />0 <br />Avenue, Mrs. Harris, owner of property in Emerald Lake, all spoke on the question. There was a very <br />lengthy discussion with the majority of the people speaking against glenwood Avenue and Capyon Road <br />being included in the assessment district. Councilman Spillers moved that the public hearing be closed, <br />seconded by Councilman Granger and carried. <br />Councilman Spillers offered Resolution of public convenience and necessity and moved its adoption, seconded <br />by Councilman Granger. This was followed by discussion as to what effect this Resolution would have -on <br />the assessment district, whether or not it would overrule all protests, whether or not the petition which <br />was presented and read protesting the inclusion of Glenwood and Canyon,Road would carry over to the next <br />and all succeeding public hearings or be overruled by adoption of this resolution. The City Attorney <br />stated the 6/7th vote was required to pass this resolution. The motion lost on roll call with Councilman <br />Stout and Weiss voting No and Councilman Britschgi being noted absent. <br />The City Attorney stated that there were two steps which the Council could decide upon. The Council <br />could <br />go through with the proceedings <br />of the Debt <br />Limitation Act <br />which would <br />increase the <br />overall cost <br />of the <br />assessment proceedings or they <br />could start <br />all over again <br />with another <br />Resolution <br />of Preliminary <br />Determination. Councilman Spillers spoke on subject and stated that he was of the opinion that the <br />Council should call for the bids and then if the bids were not what they wanted then the Council could <br />possibly pay a shake of the cost and proceed with the project. This was followed by discussion as to <br />what the next Council action would be. Councilman Stout explained why he voted no and he also stated <br />his feelings on this matter. Councilman Herkner objected to the City paying for proceedings and then <br />not having the project go through. He wanted to know approximately how much this project has cost the <br />City at the present time. City Engineer Jain stated that the cost is approximately $15,000. <br />City Attorney Currie again explained what proceedings the Council could take. He said the Council could <br />request a new resolution amending the plans and eliminate the area in question. This was followed by <br />discussion after which Councilman Stout moved that the City Engineer amend the plans and specifications <br />to eliminate this area in question, seconded by Councilman Weiss. Councilman Herkner wanted to know <br />what the effect of the elimination of this area would have on the whole project. Fire Chief Lodi was mod <br />of the opinion that the City should contact the Fire Underwriters and show them the maps and have their <br />recommendation on this before the Council takes official action. Councilman Herkner made an amendment <br />to the motion to await the decision of the Fire Underwriters as suggested by the Fire Chief and to have <br />_ Mw <br />a study meeting to discuss this matter further, seconded by Councilman Granger who wnated a study made <br />.ri <br />and not a survey. Councilman Spillers wanted to know if it would be possible to have an answer in one <br />week. Fire Chief Lodi was requested to see if this would be possible and the motion carried. <br />COUNCILMAN WEISS REPORT REGARDING RAPID TRANSIT.
