aii this location, commonly known as "The Brewster Boarding House", applied to the <br />Planning Commission for a use Permit to change existing occupancy to allow business <br />use of residential building for an old age boarding home. On a hearing before the <br />Planning Commission, the use was denied. The applicant appealed to the City Council <br />and a Public Hearing was set for December 19, 1955• At this hearing, under instruc- <br />tions of the City Council, the Fire and Building Departments were instructed to submit <br />a joint report. <br />1. This non -conforming building is located Fire Zone No. 1 <br />2. Usable space under entire main floor does not now conform to the existing building <br />Code (Section #1703) for a one hour fire resistive structure. <br />3. Exits as required, do not comply with Section 3302-B, <br />4. Corridors and opening in same do not comply with Section 3304-G, <br />5. Due to the classification of the occupancy, this building would fall under <br />Section 901 division 3 and Section 902, third paragraph. <br />6. Due to the type of occupancy and the character of the existing structure, a <br />definite physical hazard could result to the occupants of this non -conforming building. <br />7. This structure, to be used as a home for aged, does not conform to the requirements of <br />the Welfare and Institution Code due to its location in the heavily traveled area of <br />the central business district. <br />8. It is our combined opinion that this type of occupancy in this non -conforming <br />structure, is not allowable by the Redwood City Building Code. <br />S. H. Kroisss Building Inspector <br />G..P. City Manager Rolison <br />stated that it was his understanding that -the State will only issue a permit if it is approved by the <br />City. This was followed by discussion as to why the State had not been contacted. IF the State would <br />accept the City and County reports, and if the County, in this case, would be acting on behalf of the <br />state Government. Councilman Royer moved that the public hearing be closed, seconded,by Councilman <br />Spillers and carried. Councilman Royer moved approval of the Planning Commission's recommendation to <br />deny application, seconded by Councilman Spillers -and carried. <br />PUBLIC HEARING, ADOPTION OF ORDINANCE ESTABLISH VETERANS MEMORIAL BUILDING COMMISSION. Affidavit of public- <br />ation was ordered filed. There being no protests, written or oral, Councilman Spillers moved that the <br />public hearing be closed, seconded by Councilman Janes and carried. Councilman Spillers offered ORDINANCE <br />813 ESTABLISHING A VETERANS MEMORIAL COMMISSION AND PRESCRIBING THE TERMS OF THE MEMBERS THEREOF AND <br />DEFINING THE PONERS AND DUTIES OF SUCH KERS and moved its adoption, seconded by Councilman Britschgi <br />and carried on roll call. - <br />RECOMMENDATIONS AND SUGGESTIONS, COUNCIL AND DEPARTMENT HEADS. <br />Councilman Jones asked that the City Manager be allowed to proceed with the acquisition of any remaining <br />parcels along the creek from Middlefield Road to Main Street in connection with the creek covering project. <br />Councilman Jones so moved, seconded by Councilman Spillers. City Manager Rolison stated that the City <br />Attorney is ready to proceed on this matter, and he further asked that the Council to advise his of what <br />action they wanted him to take. The mayor asked that he proceed with the plan as brought up informally <br />at a former meeting. Motion carried. <br />Councilman Spillers was of the opinion that the Chamber of Commerce should be reimbursed that $75.00 -deposit <br />they put up for the Redwood City Softball Team and he so moved, seconded by Councilman Royer, City <br />Attorney Currie stated that this could not be done at this time as it should have been considered at <br />budget time or bg considered in the next years budget. Councilman Royer stated that it had been over- <br />looked and there must be some way in which the money could be refunded. Councilman Spillers withdrew his <br />motion and then offered RESOLUTION 1957 TRANSFERRING $75.00 TO THE CHAMBER OF COMMERCE BUDGET FROM THE <br />UNBUDGETED RESERVE and moved its adoption, seconded by Councilman Granger and carried on roll call. <br />Councilman Spillers brought up the subject of the flooded condition during the last storm in the vicinity of <br />:,, P , <br />iii <br />pro", <br />.r.r <br />
