ATTORNEY MELVIN COHN PRESENTING REQUEST OF MR. HEDLUND, CORNER HILLTOP AND ALAMEDA, FOR PERMISSION TO <br />BREAK CURB TO ALLOW CARS TO DRIVE ON PROPERTY. The letter stated that they were asking consideration <br />in allowing the curb to be broken so that -there is sufficient space for three cars to drive on the <br />property abreast so that Mr. Hedlund will not be compelled to have two cars on the street at night. *: <br />Councilman Spillers moved to refer this to the city engineer for a report in two weeks, seconded by <br />Councilman Weiss and carried. <br />The Mayor expressed his appreciation to the City employees who fixed up the ball park and he recommended <br />that anyone who had not been out to the ball park try and attend a game. Councilman Stout moved , <br />seconded by Councilman Spillers, that a letter be written to the Department Heads who work on this <br />park. The motion carried. <br />The Clerk stated that he had the Declaration of Restrictions signed by Mr. and Mrs. Pokorny, covering <br />Lot 17, Wellesley Park. This was brought up for the introduction of an ordinance rezoning Lot 17 and <br />the public hearing on the adoption of the ordinance can be held on August 20th. Councilman Spillers <br />offered introduction of the ordinance, seconded by Councilman Weiss and carried. <br />Councilman Granger asked that the Real Estate Committee be allowed to make a recommendation in regard to <br />the property on Hess Road. He reported that this property was worth $150.00. Councilman Spillers <br />moved authorization for this parcel to be advertised for bid, seconded by Councilman Weiss and carried <br />on roll call. <br />City.Attorney Currie asked about the creek covering of the property in back of Penny's Parking Lot. He <br />asked that the minutes show that the Council agreed to remove the guard rail and nothing more than a <br />man hole to be constructed in the sidewalk, whatever is done beyond that will be subject to the <br />property owners paying for the work. City Manager Rolison stated that it was his understanding that <br />if the City Engineer approved the plan of Mr. Adamson then this work will be approved by the Council <br />and the work will be done tomorrow. City Engineer Jain stated that while he does not agree with all <br />the plans he will go along with the proposal. He stated that he did not favor a trash rack nor does <br />he favor a man hole rather than a hatch. <br />Councilman Herkner moved that this be approved according to the recommendation of the City Engineer <br />and Mr. Adamson. City Attorney Currie stated that he wanted the Council to agree to pay for the <br />removal of the guard rail, reconstruct sidewalk, placing of a man hole in the sidewalk area, nothing <br />elso to be constructed over the property line other than the man hole in the sidewalk area. The <br />foregoing be conditioned on the property owners covering the creek from the rear of Penny's to <br />Middlefield Road. The motion lost for lack of a second. City Engineer Jain stated that Oscar <br />Holmes told him that the cost for this work would be approximately $2,000. This brought on further <br />,discussion between the figures quoted to the Council a woeek or two ago of $19000 and the $2,000 <br />quoted by Mr. Jain. <br />,Councilman Britschgi moved approval of the City Attorney's request wherein the City will pay for the <br />removal of the guard rail, reconstruct the sidewalk, placing of a manhole in the sidewalk area, <br />nothing else to be constructed over the property line other than the manhole in the sidewalk area. <br />The foregoing is conditioned on the property owners covering the creek from the rear of Penny's <br />parking lot to Middlefild Road, seconded by Councilman Spillers, In answer to Tom Tuite, The City <br />Attorney stated that it would be illegal to take money from the parking district funds. Councilman <br />Stout raised the question of an agreement between the City and the property owners in question. <br />Mr. Currie stated that the minutes will take the place of an agreement.
