City Clerk read report of Council
Committee, Councilmen Weiss and Stout:
Your committee to explore the problem of sidewalk repairs on the 300 block•of Chestnut Street
desires to submit the following report:
After consideration of all possible information availablep by consultation with the Deputy
City Engineer and interviews with property owners involved, we have come to the following
conclusions:
a. Though no written records are on file, one of the property owners was able
to establish that driveway approaches did exist prior to the resurfacing of
this block by the contractor, and it is self evident that they have never
been replaced. That the driveways involved in front of 312021029 and 322
Chestnut Street are ' of approximately 135 square feet of area.
b. That the condition of the sidewalks running in front of Lots 7 and 8, 312
Chestnut Street, Jamison property; Lot 9, 332 Chestnut Street, S. J. Miller
and Lots 109 11 and 12, San Mateo County Agriculture Department property are
in such condition that repairs must be had.
c. That as a result of work by contractor some 25 feet of sidewalk in fron of
312 Chestnut (Jamison was damaged as a result of the work of the contractor.
d. That the property owners are cognizant of their responsibility, but likewise
insist on the city assuming its responsiblity for failure to require contractor
to replace driveways and for portion of sidewalk damaged by said contractor.
e. That because of time elapsed no recourse against contractor is now possible.
Recommendations -
a• That the City assume responsibility for the 4 driveways, approximately 135
sqo ft. in area as well as the 25 ft* portion of sidewalk damaged by
contractor.
b. That sidewalks as indicated on.rattached sketch be repaired in accordance
with sidewalk ordinance at property owners expense subject to appropriate
credit as indicated in "A" above,
c. That the City Engineer be instructed to proceed in accordance with above
recommendations under the sidewalk ordinance.
Respectfully submitted,
Louis Weiss and Hiram S. Stout, Councilmen
Mrs. T. Carolla, representing Mrs. Jamieson, appeared stating that after meeting with the committee, certain
information had come to hand which she thought should have a bearing on the matter. Estimates have been
received from'Tour contractors, and bhe was advised that if the sidewalks were built according to city
specifications it would result in same being higher than property due to grade of street rising to meet.
