Granger moved that the permit be granted, seconded by Councilman Weiss who asked what effect the water <br />improvements would have on this area. Mr. Winter stated that this would not have any effect on the water <br />situation. Councilman Britschgi stated that he could not go along with this motion and referred again <br />to previous Council action in regard to Emerald Lake connections. He mentioned the Hunt case. Council- <br />man Granger referred to the water tank which was just across the road from Mr. Knudsen's property. The <br />motion lost on roll call with Councilmen Britschgi and Herkner and Mayor Royer voting No and Councilmen <br />Spillers and Stout being noted absent. Mayor Royer requested that this item be carried on the agenda <br />for two weeks until such time as there is a full council. Councilman Weiss offered a motion to revaluate <br />the existing policy in regard to the water problem in Emerald Lake. Councilman Britschgi stated that <br />the Council already did this, and since this has been brought up he wants a list.of all the property <br />owners who had been turned down, Councilman Britschgi seconded the motion which carried with Councilmen <br />Granger and Herkner voting No. The Mayor announced that he would have a study meeting as soon as Orli <br />possible. <br />Mayor Royer introduced Robert Costello who will be the new City Attorney starting September 1st, <br />INDRODUCE ORDINANCE ESTABT�ISHING 1956-57 TAX RATE. The Clerk read the final budget message submitted by <br />the City Manager. In his message the City Manager asked the Council to recall that the preliminary <br />tax study, dated May 31, 1956, called for an estimated maximum tax rate of $1.1951, exclusive of <br />capital improvements. Also, that during budget studies, an additional Capital Tax of five cents, as <br />provided by Section 57 of the City Charter, was.added for the financing of necessary Captial expenditures, <br />not included in the preliminary operating budget. Upon f ictal revision, it is now determined that an <br />overall maximum tax,rate of 1924 per one hundred dollars of assessed valuation will be sufficient to <br />provide all necessary funds required by the combined 1956-57 Annual Budget. <br />Councilman Herkner moved to approve the recommendation of the City Manager and offered intnoduetion of "" <br />the ordinance establishing the 1956-57 tax rate, seconded by Council.mah Britschgi. Councilman Weiss � <br />read the following statement: <br />This is another item that I would have appreciated some advance information on. I <br />realize that we have already adopted a budget, and that therefore this would appear to be <br />a somewhat routine matter. Necessarily, and under the circumstances involved, and realiz- <br />ing that the City Manager and the various department heads have given this matter their <br />serious attention in accordance with the practice heretofor prevailing, it is not my <br />intention to interpose any objection, but I wish for the record to state that the time <br />has arrived for us to give closer attention to all such important matters, especially <br />with respect to being furnished comprehensive date in advance that will enable us to <br />properly weigh each matter on its merits. Incidentally, I would like to take this opport- <br />unity to state that my observation as a method of operation in some other communities, I <br />find that it is the general practice that councilmen are furnished data and drafts of <br />resolutions and ordinances in advance, and that great number of them require more than <br />one reading and public hearings before adoption. <br />This was followed by discussion. Councilman Herkner stated that if the Council adopted the budget <br />then they have to adopt the tax rate and this is just a routine matter. Councilman Granger asked <br />the City Attorney if the action taken by the Council was legal. Mr. Lebsack stated that the Council <br />action is legal. This was followed by further discussion. The Mayor explained the 50¢ assessment <br />rate. The motion carried on roll call with Councilmen Spillers and Stout being noted absent. <br />ADOPTION OF RESOLUTION OF IN`ENTION TO ADOPT SALES TAX ORDINANCE UNDER CERTAIN CONDITIONS. Councilman <br />Herkner moved to carry this on the agenda for two weeks, seconded by Councilman Britschgi who asked <br />that a copy be mailed to all the Council. He was <br />told his motionmas out of order. Councilman Zeiss then moved to table the motion. The motion to table <br />lost for lack of a second.
