This was followed by <br />discussion after which the motion carried on roll with Councilman 7,7eiss voting No and Councilmen Spillers <br />and Stout being noted absent. <br />V x ,?. <br />RESOLUTION 9092 TRANSFERRING GENERAL RESERVE FUND TO THE GENERAL FUND 17AS offered by Councilman Britschgi who <br />moved its adoption, seconded by Councilman Herkner and carried on roll call with Councilmen Spillers and <br />Stout being noted absent. <br />ADOPTION OF RESOLUTION AUTHORIZING QUIT CLAIM DEED TO E. CERQUI TO CORRECT BOUNDARY DESCRIPTION. Attorney <br />Lebsack stated that this is a result of the Poplar-Hess-Ebener improvements and is to correct an original <br />deed. Councilman Britschgi offered RESOLUTION -209:3 AUTHORIZING QUIT CLAIM DEED TO E. CERQUI TO COFaECT <br />BOUNDARY DESCRIPTION and moved its adoption, seconded by Councilman Granger and carried on roll call with <br />Councilman Spillers and Stout being noted absent. <br />PROPOSED LOCATION OF FUTURE FIREHOUSE IN STULSAFT PARK AREA. It was announced that by using Stulsaft Park the <br />City would save approximately $6,000 by not having to purchase a site in the Farm Hills Subdivision. The <br />Clerk read the following letter submitted by the Park and Recreation Commission: <br />This is to advise you that our group has no objection to the location of a Fire Station in <br />Stulsaft Park; in fact, we welcome it as a safety feature. This point has already been <br />discussed by Chief Lodi and Mr. Hastings of the firm of Murphy and Hastings, and we are <br />sure a suitable arrangement can be worked out to the satisfaction of all. <br />Councilman Herkner wanted to know the size of the lot. He was told that it was either 60 or 70' x 100'. <br />Councilman Herkner moved approval subject to providing suitable architectural design to tie into the area <br />and also subject to the approval of the Council and the Fire Chief, seconded by Councilman Britschgi and <br />carried. - <br />CITY ENGINEER -RECOMMENDATION REGARDING HEDLUND REQUEST FOR ADDITIONAL DRIVDVAYS, HILLTOP DRIVE. The Clerk read <br />the City Engineer's letter wherein it was stated that the owners of this property have converted a double <br />garage into living quarters and have left only a single garage at the end of the residence building. The <br />concrete double driveway to the previous double garage is now being used for a patio area. It has not been <br />the policy of the City in the past to allow or grant driveway permits except to serve an existing garage, <br />unless a building permit for an additional garage was obtained before construction of the driveway. It <br />was the City Engineer's recommendation that the request for additional driveways be denied inasmuch as the <br />garage which these driveways would serve had been abandoned and converted to residential use. Many others <br />in the city have been denied the same privilege. <br />Councilman Herkner stated that he had gone out to look at the property and he was of the opinion that this <br />was used for parking and not for a patio. Mr. Jain stated that the Council has turned down several other <br />similar items, one of the latest being that of Mr. Bevilockway. Mr. Hedlund stated that he did not use <br />this as a patio. This was followed by discussion. The building Inspector stated that he did not believe <br />that the Council should grant this permit because they would be setting a president. Councilman Britschgi <br />moved that the request be denied, seconded by Councilman Granger and carried. <br />CITY ENGINEER REGARDING PECAN COURT AND KENTFIELD=-PAL1d-VALOTA DRAINAGE. The Clerk read the following: <br />"In approving the final map of Pecan Court Tract, east of Valota Road, the subdivider was <br />required to construct a 12 -inch R. C. P. Storm drain to Kentfield Avenue, and to deposit <br />the sum of $4000 with proposed Kentfield-Palm-Valota Improvement District. <br />It has now developed that the 12 -inch storm drain required for Pecan Court Tract to <br />Kentfiled Avenue would have to be removed to allow construction of the proposed 27 -inch <br />storm drain when the large assessment district is developed, as they would both be within the same <br />easement, which is not wide enough to accommodate both structures. The 12 -inch storm <br />drain would serve no purpose after the 27 -inch drain is constructed. <br />It is our recommendation that the offer of the subdivider to construct 36 feet of 12 -inch <br />R. C. P., 120 feet of 27 -inch R. C. P., two manholes, and necessary sub inlets for future <br />connection, as shown on the attached drawing, be accepted, and that he be reimbursed in an <br />estimated amount not to exceed $2000 from his $4000 deposit with the City. The remainder of <br />the deposit will be retained to cover any additional assesments against property in Pecan <br />Court Tract for storm drainage improvements. It is our opinion that this alternate consture- <br />tion can be justified in order to avoid duplication of construction, and to save unnecessary <br />
