0 <br />11 <br />El <br />10 <br />2n5 <br />CITY ATTORNEY REPORT REGARDING PARK AND RECREATION COMMISSION RECOMMENDATION TO ABANDON AND BLOCK OFF SMALL <br />TRIANAGULAR PARK IN THE VICINITY OF ANAMORs KENTUCKY$ ETC, City Attorney Costello stated that he <br />reported before as to the procedure to block off this park. He allted that he talked with Mr. Gold and <br />the Park and Recreation Commission request that the park be abandon. The Commission feel that the matter <br />of the -sidewalks is up to the Council. <br />Mrs. Albert Thomas, 1705 Connectfcut.9 presented a letter from the residents in the area which the Clerk <br />read. Their letter was a request that the sidewalk alleyway and "park" between Connecticut Drive„ Anamor <br />and Massachusetts Streets be closed and discontinued inasmuch as it has become a fire hazard, a health <br />hazard and a public nuisance. Them were,15 signatures on the letter. Councilman Stout raised the <br />question of.whether or not the property owners whold•absorb this property as a part of their property and <br />thus do away with the sidewalks. Mrs. Thomas stated that all the property owners have verbally agreed <br />to move their fences. The. Mayor appointed Councilmen Spillers$ chairman$ and Stout to work as a <br />Committee to meet with the people and report back to the Council. <br />CITY ENGINEER REPORT ON SIDEffALK CONDITIONS IN THE VICINITY OF QUARTZ AND ST. FRANCIS STREETS. It was noted <br />.in the report that approximately 120 lineal feet of the frontage across which there are no existing <br />sidewalks is across Hatch Hetchy right -of -sway property. There has been some question as to whether the <br />City could enforce the sidewalk ordinance against property owned by a public utility such as the San <br />Francisco Water Department. If this could be required, it is the City Engineer's r ecommendation that his <br />office.be instructed to send legal notices to construct and repair sidwalks in all those protions <br />indicated as needing such work* Councilman Granger suggested that they notify all the property owners$ <br />including the Water Departments and let them tell the City why they will not do the work* Councilman <br />Britschgi stated that he believed that the Rater Company has agreement with the City that the City has to <br />maintain: the sidewalks$ street works etc. This was followed by discussion. <br />Councilman Stout moved that the City Engineer proceed along the usual channels to have the sidewalks <br />installed$ seconded by Councilman Spillers. City Attorney Costello advised the Council that the crossing of <br />the Hetch.Hetchy right-of-=way was governed by a revocable permit and the City must put in all improvements <br />and hold the Hetch Hetchy harmless. The only way that the Council could get the sidewalks repaired was to <br />start condemnation proceedings. He felt that there was no need for this and for contacting the Hatch Hetehy <br />Company and suggested that the City do the work. City Engineer Jain stated that he would check with the <br />City Attorney before taking any action on the Hatch Hetchy right-cf-+way. The motion carried. <br />Councilman Spillers requested the matter of bridges be placed on the agenda for next week. <br />The Mayor asked that the meeting be recessed until 10 o'clock. The meeting was recessed at 9:35 P. M. <br />The Mayor called the meeting to order at 10:35 P. M. -and announced that the agenda had been completed. <br />The City Attorney stated that he had an emergency ordinance ready for introduction* This ordinance should be <br />considered an emergency and would establish regulations for connection -to the sanitary sewer system and <br />prohibiting occupancy of buildings producing damage or overload to the sanitary, sewer system of the City <br />of Redwood City. Councilman Granger moved that the City Attorney furnish a copy of this ordinance to each <br />of the Council so they can make a reply next week$ seconded by Councilman Spillers. Councilman Weiss stated <br />that this was an emergency ordinance and, as such, this should be intorduced tonight and the Council can <br />make their decision nest week. Councilman Weiss moved a substitute motion to introduce the ordinance. <br />The Mayor asked the City Attorney if this substitute motion was in order. The City Attorney ruled it was <br />out of order. Councilman Weiss then moved that the matter be tabled. This motion lost for lack of a <br />second and was followed by discussion. Mr. Oddstad has agreed that there will not be any occupancy until <br />the Council has agreed to the adoption of this ordinance. City Enginneer Jain stated that the situation <br />was criticals the present sewage should be -removed before winter. Councilman Herkner stated that he <br />wanted it understood that no one can get a hook up under the present situation. The Mayor announced that <br />
