<br />entrances to this school site, and to eliminate any possibility of construction during
<br />the rainy season. We are concerned that the same conditions of construction will prevail
<br />that occurred during the construction of the Foothill and Carson Street main last Fall
<br />where a great deal of inconvenience was caused to adjoining property owners.
<br />Unless the Planning Commission and City Council determine otherwise, no sewer
<br />connections will be permitted in the Farm Hill No. 2 subdivision until completion and
<br />acceptance of Relief Sewer IX.

<br />Sanitary Sewer Facilities
<br />Pursuant to the Council's instructions at a study meeting held on Friday, October
<br />5, 1956, a further investigation has been made of the sanitary sewer system serving the Farm
<br />Hill Subdivisions, by the Engineering Department, the results of which are set forth in
<br />the attached letter from the City Engineer, addressed to this office under date of
<br />October 8, 1956.
<br />I have also discussed this matter with the City Attorney, who advises that, if
<br />deemed necessary, the occupancy of any additional dwellings in this area may be prohibited
<br />by the adoption of an emergency ordinance, which he has prepared.
<br />In view of the City's potential liability as outlined by the City Engineer's letter,
<br />it would be my recommendation for the City's protection, that, unless the subdivider is
<br />prepared to hold the City harmless by entering into an agreement whereby he accepts full
<br />responsibility for all damages which may resplt from the above conditions, that the
<br />occupancy of no additional dwellings in this area be permitted, until such time as ade-
<br />quate sewer facilities have been provided.

<br />Re: Farm Hill Nos. 1 and 2 Sanitary Sewer Facilities
<br />This is to supplement my letter of October 4, 1956, addr®seed to the City Council,
<br />regarding the inadequacy of existing sanitary sewer facilities to serve the Farm Hill
<br />Nos. 1 and 2 Subdivisions.
<br />We have reviewed the existing sanitary sewer facilities in the Westwood Terrace,
<br />Redwood Terrace, and Sterling Heights Subdivisions, through mhich the sanitary sewage
<br />from the Farm Hill Subdivisions must flow, under the present temporary arrangement.
<br />We have checked the capacity of these outfall sewers, and find that the sanitary sewers
<br />in Carson Street, Truman Street, Fairview Avenue and McGarvey Avenue, in particular,
<br />are of insufficient capacity to handle sewage and storm water infiltration from the
<br />subdivisions which they were originally designed to serve.
<br />The McGarvey Avenue sewer, between Truman Street and Fairview Avenue, is only 10
<br />inches in diameter, and laid to a o.19% grade, with a maximum capacity of 0.6 million
<br />gallons per day. The present estimated discharge through this sewer is approximately
<br />0.7.6 million gallons per day during the winter season, based upon the flow from
<br />approximately 555 homes in the Westwood Terrace, Redwood Terrace and Sterling Heights
<br />subdivisions. The addition of Farm Hill Nos. 1 and 2 subdivisions, consisting of 447
<br />homes, will add approximately 0.6 million gallons per day. If the sewage from Fara
<br />Hill Nos. 1 and 2 subdivisions is allowed to flow through these lines, it will result
<br />in a flow more than double the estimate capacity of the existing critical sewer mains,
<br />(or approximately 1.37 million gallons per day.)
<br />As a temporary measure, to facilitate the development of Farm Hill No. 1, we
<br />permitted a portion of the proposed 12 inch interceptor sewer to be connected into
<br />the 8 inch sewer in Carson Street at Fernside Street, with the understanding that,
<br />before additional homes were connected,'a 12 inch interceptor sewer would be con-
<br />structed dawn Goodwin Avenue to Virginia Avenue. We did not anticipate that homes would
<br />be completed in Farm Hill No. 2 prior to the completion of the required interceptor,
<br />sewer, to connect with interceptor sewer VIII in Virginia Avenue.
<br />In view of the liability which may be incurred by the City, the City Council,
<br />and the City Officials under whose jurisdiction subdivisions fall, we wich to recommend
<br />that no further dwellings be permitted to be occupied and discharge sewage into the
<br />sanitary sewer system, until the required interceptor sewer is completed to Virginia
<br />Avenue.
<br />We realize that this will probably cause hardship on the developer of Farm Hill
<br />Nos. 1 and 2, but we feel the interest of the City must be protected. In our opinion,
<br />this sewer could have been constructed and completed prior to completion of the sanitary
<br />sewer system within the subdivision boundaries.
