<br />driveway access to Woodside Road. The Commission further proposed conditions that a retaining wall be
<br />constructed along the creek, to the approval of the City Engineer, and that the architecture of the building
<br />be approved by the Planning Commission prior to obtaining a building permit.
<br />Miss Jane Logan presented a letter of protest on behalf of the residents and property owners of Nimitz
<br />�.. Avenue. The protest is made to granting approval of Meleyco's request for a variance. The City Attorney
<br />asked that this protest be referred to him for a report back in one week. Councilman Stout moved to refer
<br />this to the City Attorney for a report back in one week, seconded by Councilman Weiss. This was followed by
<br />Councilman Spillers moved that the public hearing be set for next Tuesday, seconded by Councilman Herkner.
<br />This was followed by discussion. Councilman Weiss asked that they be furnished by the Citv Attorney, his
<br />ruling before the Council meeting and also to have the ruling of the Planning Commission as to be number of
<br />units he will be allowed to build. The motion carried.
<br />USE PERMITS CONSIDERED BY THE PLANNING C OMISSION :
<br />1. Apprival of the application of F. J. MacDonal, to allow a codktail lounge at Lot 91 Block 9, Range B
<br />Mezesville (800 Block of Brewster). No Council action was taken.
<br />2. Denied R. Davis a use permit allowing a public garage on a portion of Lot 6, Hill Knowles Tract, and a
<br />portion of Lot 238, Tract 515 Recwood Village (Flynn Avenue and Middlefield Road) .
<br />The Planning Commission also denied the applicant's request for a resubdivision of a portion of Lot 238,
<br />Tract 5115 Redwood Village, to be incorporat3d into portion of Lot 6, Hill Knowles Tract, on the basis
<br />that Lot 238 is now zoned R-1 and Lot 6 is now zoned C -1-H. This was set for apublic hearing in two weeks*
<br />3. Denied L. Brown a use per.:.it to allow professional offices in a residential building in a C -1 -HF zone
<br />at 532 Winslow and 512 Allerton Street. The proposed use in a residential building would be detrimental
<br />to the surrounding area and the applicant should comply with the provisions of the No. 1 Fire District.
<br />This was set for a public hearing in two weeks.
<br />The City Attorney stated that he had a resolutionprepared for presentation tongiht. This resolution repeals
<br />Resolution 2126 wherein the City was authorized to sell Lot 4, Block 1, Resubdivision of Lot 46, Reese
<br />Subdivision to William J. Mora. This new resolution azthorizl'd the sale to William J. Mora and Carmen M.
<br />Mora, his wife. Councilman Spillers offered RESOLUTION 2135 AUTHORIZING SALE OF LOT 4, Block 1, RESUB-
<br />DIVISION OF LOT 46s REESE SUBDIVISION TO WILLIAM J. MORA AND CARMEN M. MORA, AND REPEALING RESOLUTION NO.
<br />2126 and moved its adoption, seconded by Councilman Granger and carried on roll call, Councilman Britschgi
<br />being noted absent.
<br />A resident in the vicinity of Goodwin Avenue complained about the sewer project in them, vicinity. He wanted
<br />r to know why they couldn't clean up the mess and fill in the holes. Mr. Jain stated that they (Oddstad Homes)
<br />Lo have'all but 400' of sewer in the ground. He further stated that his office has never had any complaints
<br />about the mess but they will check into the matter. The Mayor asked the City Engineer to check into this
<br />matter and attempt to clean up the street.
<br />Progress Payments on Industrial Way and Parking Lot IV were noted. The Clerk stated that they were included
<br />in the payment of the claims which is up for approval tonight.
<br />Councilman Granger brought up the matter of traffic meter study. He wondered if the Traffic Committbe could
<br />make a study as to the amount of money is put in the parking meters and the amount of people who use the
<br />meters before 10 o'clock. Councilman Granger had in mind of changing the free parking until 10 o'clock
<br />in the morning. Chief Faulstich stated that they would have to the ordinance if this was allowed.
<br />Councilman Spillers stated that he would like to have free parking on Saturdays as well as Sundays. He
