He did not feel that this delay would hurt this matter any and might help the situation. <br /> Councilman Stout offered a substitue motion that the matter be tabled for 90 days (Ordinance 843) and if <br /> the Council wishes they may include the use tax ordinance . The motion to table was in order and was <br /> , seconded by Councilman Spillers. The motion lost on roll call with Councilmen Granger, Herkner, Weiss, <br /> Weymouth and Royer voting NO, Councilmen Spillers and Stout voting Yes. The original motion to adopt <br /> ordinance 843 carried on roll call vote with Councilmen Herkner, Spillers and Stout voting NO. <br /> The City Attorney read the title of the ordinance No. 8411. Affidavit of publication was ordered filed. <br /> Councilman Weymouth offered ORDINANCE 844 AN ORDINANCE OF THE CITY OF REDWOOD CITY IMPOSING AN EXCISE TAX <br /> ' ON THE'STORAGE, USE OF OTHER CONSUMPTION OF TANGIBLE PERSONAL PROPERTY and moved its adoption, seconded by <br /> Councilman Granger and carried on roll call, Councilman Herkner, Spillers and Stout voting NO. <br /> The affidavit of publication of Ordinance No. 845 was ordered filed and City Attorney read the title of <br /> Ordinance as follows: ORDINANCE 845 AND ORDINANCE OF THE CITY OF REDWOOD CITY, IMPOSING A CITY SALES AND <br /> USE TAX: PROVIDING FOR THE PERFORMANCE BY THE STATE BOARD OF EQUALIZATION OF ALL FUNCTIONS INCIDENT TO <br /> THE ADMINISTRATION, OPERATION AND COLLECTION OF THE SALES AND USE TAX HEREBY IMPOSED: SUSPENDING THE <br /> PROVISIONSOF ORDINANCES NOS. 843 AND 844 DURING SUCH TIME AS THIS ORDINANCE IS OPERATIVE; AND PROVIDING <br /> PENALTIES FOR VIOLATIONS THEREOF. Councilman Herkner moved its adoption, seconded by Councilman Stout. <br /> Mr. Davies stated that the people were against the sales tax, city wise and county wise. The Mayor asked <br /> the City Attorney to read the title of the ordinance. The motion carried on roll c allwith Councilman <br /> Spillers voting NO. <br /> Councilman Herkner ased that the minutes show that the ordinance just passed will protect the City in the <br /> event that something rules Ordinance 843 out of order or something should happen to the ordinance. The <br /> rimm. City Attorney ruled that this statement was correct as long as no initiative measure, Charter Amendment <br /> or legal action questions the validity of Ordinance 845. This was followed by discussion. Councilman <br /> Granger asked that the record show that he has never one talked to mayor williams as intimated by Mr. Al <br /> Davies. Councilmen Weiss and Weymouth stated that they had not talked to Mayor Williams and had not been <br /> influenced by him in any way. This was followed by discussion. The Mayor asked the Tribune reporter to <br /> make it clear in the paper what would happen if the County sales tax is made county wide. <br /> CITY ATTORNEY READ THE TITLE AND ORDINANCE 846, AN ORDINANCE OF THE CITY OF REDWOOD CITY PROVIDING FOR <br /> THE ALLOCATION OF CERTAIN REVENUES OF THE CITY; ESTABLISHING A MAXIMUM TAX RATE FOR GENERAL MUNICIPAL <br /> PURPOSES; AND, PROVIDING FOR SUBMISSION OF A MEASURE AT THE NEXT GENERAL ELCTION RELATIVE TO SAID MATTERS. <br /> The affidavit of publication was ordered filed. Councilman Stout offered Ordinance 846 and moved its <br /> adoption, seconded by Councilman Weiss. Councilman Weymouth asked that in the event the proposed initiative <br /> ordinance is adopted by the people and then the County adopts a uniform sales and use tax would the people <br /> of Redwood City be taxed and all the money go to the County? The City Attorney answered yes to the <br /> 610, question. This was followed by further discussion in regard to the county—wide sales tax. Mr. Lebsack <br /> spoke on the question and spoke on the matter referendum. He stated that referendum was not available <br /> and the only recourse let was initiative action. The motion carried on roll call with Councilman Spillers <br /> voting No. <br /> [1: The Mayor declared a 5 minutes recess, 10:50 P. M. <br /> The meeting was called to order at 11:00 P.M. <br /> JOHN & HELEN MC CUNE AND RUTH E. SAWYER REGARDING HILLTOP DRitiE IMPROVEMENTS. The Clerk read the letters. <br /> The Mayor stated that the City has a one year guaranty against defective meterials. Councilman Herkner <br /> moved that these communications be referred to the proper authorities for action or investigation, seconded. <br /> by Councilman Granger who asked that the City Manager be the proper authority. The motion carried. <br />
