491 <br /> of Winslow Street to the rear of the new building on the north side of Winslow. <br /> As of this date, we are unable to secure a permit from the City Engineer for this <br /> installation of a private service across a city street. It is Mr. Jain's contention . <br /> that the P. G. & E. should either do this work or have a permit issured in their name <br /> thereby assuming responsibility. The P. G. & E. flatly refuses to do the work or take out <br /> a permit for same. <br /> Consequently we are at an impasse and respectfully request you consideration and <br /> decision. <br /> (11:: The City Engineer stated that the City has not issured any permits to private companies to make use of <br /> City streets for private use. This should be either City owned or utility owned so it can be maintained <br /> and controlled properly. Mr. Jain suggested that the Council take-the stand and advise the Utility Companies <br /> if this is to be served it will be necessary for them to take out a permit to install the underground <br /> [1:1: circuit. The City Attorney was asked to check into this matter. <br /> Councilman Spillers moved that the request be denied and the public utilities be notified that it will be <br /> underground and ask that they put in the installation, seconded by Councilman Stout. This was followed by <br /> discussion in regard to whether or not the public utilities can be foreced to install this underground <br /> circuit. Councilman Stout wanted to know if this was going to be setting a policy. The City Attorney <br /> stated that the City has an ordinance that anything put in the street can only be done so by permission <br /> from the Council. The motion carried on roll call with Councilman Granger voting NO. <br /> Councilman Stout suggested that the City manager bring in a survey as to what streets should have underground <br /> circuits. Councilman Stout moved that the Planning Commission revaluate the streets and list the streets <br /> that they want to have underground circuits, seconded by Councilman Spillers and carried. <br /> TRAFFIC COMMITTEE RECOMMENDATION REGARDING REALIGNMENT VALOrA ROAD AT WOODSIDE ROAD. The Committee recommends <br /> that there be no re-aligning of Valota Road as the widening of Woodside Road at a future date and the <br /> construction of a service road on the north side of Woodside Road will be sufficient to accomodate the flow <br /> of traffic at this location. Councilman Stout moved approval of the recommendation of the Traffic Committee, <br /> �r.. <br /> seconded by Councilman Spillers and carried. <br /> PLANNING COMMISSION RECOMMENDED APPROVAL C. BONMAN REQUEST TO REZONE PORTION LOT 11, BLOCK G, WOODSIDE ACRES <br /> (1631 UNION) FROM R-2 TO R-3-G IF, AND WHEN, THE COUNCIL APPROVES THE LAND USE PLAN. Councilman Spillers <br /> moved to set this matter for public hearing in two weeks, seconded by Councilman Stout. The City Attorney <br /> stated that the recommendation is to rezone from R-3 to R-3-G and he suggested that this matter be held until <br /> the Council considers R-3-G zoning. He recommended that this matter be continued until such time as the <br /> amendment is placed on the agenda. Councilman Spillers changed his motion to continue this matter until <br /> such time as the amendment is placed on the agenda for R-3-G zoning. The motion carried. <br /> PLANNING COMMISSION REQUEST APPROVAL TO ALLOW TWO OR THREE MEMBERS OF THE PLANNING COMMISSION TO ATTEND ONE OR <br /> TWO DAYS OF THE AMERICAN SOCIETY OF PLANNING OFFICIALS ANNUAL MEETING in San Francisco March 17th to 30th. <br /> Councilman Spillers moved approval to allow the Planning Commission to attend the conference and they be <br /> reimbursed for their expenses, seconded by Councilman Granger and c arried. <br /> COMMUNICATION ATTORNEY LEBSACK REGARDING LEGAL SERVICES FOR ASSESSMENT PROCEEDING'=S KENTFIELD-PALM-VALOTA ROAD <br /> IMPROVEMENTS. The Clerkread the letter wherein Mr. Lebsack stated that they offer and agree to represent the <br /> City in the conduct of such proceedings and to furnish the following serviees therein: <br /> 1. Review engineering estimates, engineering design and the proposed assessment for <br /> the complete financing of said project. <br /> 2. Prepare all necessary ordinances, resolutions, contractor's agreements, notices <br /> and documents for the conduct of said proceedings as required by law. <br /> 3. Confer with you and other City officials with regard to the conduct of <br /> said proceedings. , <br /> L . Prepare all necessary documents releting to the delivery of the bonds, including, <br /> but not limited to a non-litigation certificate and any transcript of the proceedings called <br /> for by the purchaser of said bonds. <br />
