4 c 2 <br /> 56 Supervise the printing of the bonds and the preparation of the Treasurer's bond <br /> register. <br /> 6. Provide our unqualified legal opinion supporting the legality of the assessment <br /> and the bonds to represent unpaid asseaments when issured and a 11 proceedings leading up to <br /> the issuance of the bonds and their delivery. <br /> Our fee for the rendering of such services shall be 2% of the contract cost of the project. <br /> In the event if is necessary to acquire property by negotiation or eminent domain proceedings, we <br /> shall expect to receive reasonable additional compensation for any servies so rendered. <br /> In the event of litigation not caused by our error, we shall expect to receive reasonable <br /> additional compensation for anyrvices so rendered. <br /> amid <br /> We shall be happy to proceed with the work upon receiving notice from you that you and the <br /> Council have approved this proposal. We shall be pleased to render services under the same basis <br /> on any other assessment projects which may be pending. <br /> Councilman Spillers moved approval of the City Manager's recommendation to approve the proposal, <br /> seconded by Councilman Weymouth. Councilman Weiss asked that in the event that the proceedings are <br /> not formulated for some reason or other what fee, if any, would then be paid. The City Attorney <br /> stated that in this event that no fee would be charged. Mr. Currie and Mr. Lebsack stated that if <br /> for some reason the project is not culminated that there would be no fee charged. Thismas followed <br /> by discussion. Councilman Granger asked the City Manager to also state his interpretation of Mr. <br /> Currie and Mr. Lebsack's remarks concerning whether or not a fee would be charged if the work was not <br /> completed. The City Manager stated that he was told by Mr. Currie and Mr. Lebsack that there will <br /> not be any charges if the project does not go through. The motion carried. <br /> Councilman Spillers asked the City Manager and the City Engineer to contact Mr. Currie and Mr. <br /> Lebsack and ask them to proceed as soon as possible with this work, The City Attorney recommended <br /> that the City Clerk write to Mr. Currie and Mr. Lebsack that the Council agrees with their proposal <br /> and that there will not be any fee charged if the project falls through. <br /> The City Attorney stated that he had a resolution to present to the Council. There was an error made <br /> in Resolution 2183 and this new resolution noted the correction. Councilman Stout offered <br /> RESOLUTION 2198 AMENDING RESOLUTION 2183 AUTHORIZING THE SALE OF CERTAIN PRESCRIBED PARCELS TO THE <br /> STATE OF CALIFORNIA FCR FREEWAY PURPOSES and moved its adoption, seconded by Councilman Weymouth and <br /> carried on roll call. <br /> The Mayor brought up the matter of the Citizens Committee for the Port. He stated that the Port Commissioners <br /> want to know if the Council still wants to consider this matter and if so should the proceed with the <br /> report. Councilman Weiss moved to sent the Committee a letter and give them a vote of confidence <br /> and state that they want them to paroceed with the examination, seconded by Councilman Spillers. <br /> This was folowed by discussion. Councilman Granger asked that they only check on the Port functions <br /> and not the whole of Redwood City. This was followed by discussion in regard to what the survey was <br /> to be on. The Clerk was asked to check into the records of the mintes and see *hat the thinking <br /> of the Council was in regardto this matter. The motion carried. <br /> Councilman Herkner brought up the matter of the Sequoia Reservoir, and he suggested that the Council call <br /> for bids as soon as possible. He felt that the City could secure good bids as this time. The City <br /> Attorney made a report in regard toseveral meetings he attended in which they dicussed how the bids <br /> should be considered and what should be considered in the bid. He suggested that the Council not <br /> PlIgo <br /> call for bids on bonds until such time as the City knows whether or not they are going to have suff- <br /> icient funds and plans to complete the reservoir. This was followed by discussion. The City <br /> Engineer was asked to have the plans ready iniwo weeks. Councilman Herkner moved that the City <br /> Engineer bring in a report in two weeks, seconded by Councilman Weymouth and carried. - <br /> Councilman Herkner brought up the matter of the Yacht Harbor Improvements and wanted to know when they <br /> were going to call for bids. The City Engineer stated that they are working on the Kentfield-Palm- <br /> Valota Road improvements and they consider this as the major project at the present time. They are <br />
