Webber and Senior Stenographer–Clerk Vivian Holmquist. <br /> Councilman Spillers moved approval of the minutes of March 4 and March 11 as mailed, seconded by Councilman <br /> Stout and carried. <br /> Louis Green, representative of the Junior Chamber of Commerce, presented the Courtesy Driver of the Week - <br /> Award to Mrs. James Harris, 238 Madrone Street. <br /> VFW Post 2310, Chaplin D. Tesdahl and Commander Emil Slinker presented the City with two safety signs. It is <br /> their hope that in the future they will be able to present each school with at least two such signs. <br /> Police Chief Faulstich accepted the signs for the City. <br /> PUBLIC HEARING, CITY ENGINEER AMENDED REPORT, INDUSTRIAL WAY, ASSESSMENT NO. 2. Affidavit of Publication <br /> was ordered filed. There being no protests, written or oral, Councilman Spillers moved that the public <br /> hearing be closed,- seconded by Councilman Herkner and carried. Councilman Spillers moved approval of <br /> the split of assessment #2, seconded by Councilman Herkner and carried. <br /> DISCUSSION ON PROPOSED CINNABAR LEASE. The Clerk read the following letter submitted by the City Manager: <br /> This office is in receipt of the attached lease for the term of one year, commencing <br /> July 1, 1956, and ending June 30, 1957, for the purpose of cinnabar mining in Stulsaft <br /> Park. <br /> This lease, which has just been submitted for the Council's approval, was executed by <br /> Mr. A. F. Oddstad under date of March 6, 1957, and is now awaiting the City's execution. <br /> You will recall that at the Council's request, I submitted a report on this subject <br /> under date of January 2, 1957, in which it was recommended that this lease provide <br /> for proper City inspection for the removal and processing of all ore, under the super- <br /> vision of the City Engineer. Also, that the area _to be mined by definitely described <br /> by the City Engineer. <br /> You will note that as presented, Paragraph I merely describes the area to be mined as <br /> "all of the Northerly one–half of Stulsaft Park.". Also, while Paragraph VIII requires ..r <br /> that the "Leasee shall provide inspection as designated by the Lessor" as a part of the <br /> , operating expense, no mention is made of the City Engineer, who should be inresponsible <br /> charge of these inspections. <br /> Paragraph X provides that all ore removed shall be accompanied by certified weight <br /> tickets, which shall be delivered to the lessor, but does not provide for any schedule <br /> or manner of reporting to the City Engineer's office, which must keep a record of both <br /> the ore as it is removed from the site, and the mercury as it is recovered at the <br /> processing plant. <br /> It is noted that Paragraph X also provides that "Lessee shall be allowed an additional <br /> one year within which to process and/or market the mercury removed therefrom," which <br /> may or may not be desirable from the City's standpoint. <br /> Attention is called to the above matters which were recommended in my report of <br /> January 2, 1957, in order that, it desired, this document may be further reviewed <br /> before its execution is authorized by the City Council. <br /> Councilman Granger stated that the Committee authorized the City Manager and the City Attorney to <br /> execute the agreement. Councilman "Weiss said there was some question as to whether or not this <br /> lease is in line with the previous report of the City Manager. He feels that the lease should be referred <br /> back to the City Manager for him to take appropriate action to see that the lease is amended according worth <br /> to the report of the City Manager. <br /> Councilman Weiss moved that the City Manager be instructed to have the lease drawn up as to the <br /> original discussion and bring back his approval to the City Council, seconded by Councilman Spillers. ._ <br /> Councilman Herkner stated that it appeared the only controversial matter was the one year clause. <br /> The City Manager agreed that this was one of the controversial matters. City Engineer Jain had a couple <br /> of items he was concerned about. He stated that at one time he was directed to make the inspections <br /> but, according to the lease, the Lessee is to furnish the inspection. Mr. Jain spoke for some time <br /> on the subject of inspection. Anotheritem he questioned was in regard to the Park and the possibility <br /> of destroying the vegetation.
