Councilman Herkner moved adoption of RESOLUTION NO. 2572 APPROVING PLANS, PROFILES, DETAILED DRAWINGS <br />AND SPECIFICATIONS, BEECH STREET IMPROVEMENTS., seconded by Councilman Spillers and carried unanimously <br />on roll call. <br />Councilman Weymouth moved adoption of RESOLUTION NO. 2573 BEING THE RESOLUTION W INTENTION TO CONSTRUCT <br />CERTAIN PUBLIC IMPROVEMENTS, BEECH STREET IMPROVEMENTS, seconded by Councilman Weiss and carried unan- <br />imoasly on roll call. <br />Councilman Spillers moved adoption of RESOLUTION NO. 2574 BEING THE RESOLUTION FIXING MINIMUM WAGE <br />SCALE, BEECH STREET IVROVMM US, seconded by Councilman Herkner and carried unanimously on roll call. <br />Councilman Rosselli moved adoption of RESOLUTION NO. 2575 ORDERING CALL, FOR BIDS, BEECH STREET IMPROVE - <br />P" MENTS9 seconded by Councilman Weiss and carried unanimously on roll call. (Bids to be opened an Nov- <br />i. ember 17th.) <br />EZE <br />Councilman Weiss moved that they recess for 5 minutes, seconded by Councilman Spillers and carried. <br />The meeting recessed at 8:25 p, me and reconvened at 8:30 p. m. <br />PUBLIC HEARING ON THE COUNCIL'S RESOLUTION OF INTENTION TO AMEND SECTIONS 4.4 4.2, 4.3 AND 4.4 OF ORDINANCE <br />NO. 600 TO REZONE LOTS 11, 12 AND 13, BLACK 6, WOODACRE KNOLLS, FROM R-3 DISTRICT TO C -1-H DISTRICT. <br />The affidavit of mailing was ordered filed. The Clerk read the report of the Planning Commission after <br />which Councilman Weiss read a prepared statement. There were no .written communications. After listen- <br />ing to arguments both pro and con, Councilman Granger asked Attorney Robert Dell'Ergo if he was aware <br />of what could happen if his client did not proceed with his propsed plan to build a restaurant* Mr. <br />Dell'Ergo stated he was aware that the Council has the power to act on the rezoning. The Council <br />agreed to let Councilman Granger's question be made a part of the record. <br />Councilman Weiss asked that if they did not proceed with this project within a reasonable period of <br />of time would he, Mr. Dell'Ergo, look with disfavor on the Council acting to rezone the property back <br />to its present rezoning and would he consider such action being capricious? Mr. Dell'Ergo stated that <br />he could not advise the Council and they should ask their City Attorney for a ruling. <br />This was followed by further discussion after which Councilman Spillers moved that the public hearing <br />be closed, seconded by Councilman Rosselli and carried. <br />Councilman Weiss moved to uphold the Planning Commission's recommendation and deny the rezoning. This <br />motion lost for lack of a second. Councilman Weiss then moved that his statements be made a part of <br />the record. This motion also lost for lack of a second. <br />Councilman Spillers moved to introduce an ordinance rezoning the property from R-3 to C -1-H District, <br />seconded by Councilman Rosselli. Councilman Weiss moved to table the matter until he had an opport- <br />unity to read the ordinance. The motion to table lost for lack of a second. Councilman Weiss then <br />asked that the Clerk read the ordinance.
