<br />tween Fifth Avenue and Annette Avenue) FROM C -3-H DISTRICT TO R-3 DISTRICT. The notice of mailing notice
<br />of public hearing was ordered filed. Louis DePalo, Jr., representing J. E. McCarthy who is the owner of
<br />Lot 3, Block 4, Belle Haven Subdivision, spoke at some length against the rezoning. After discussion, Coun-
<br />cilman Rosselli moved that the public hearing be closed, seconded by Councilman Spillers and carried.
<br />Councilman Weymouth moved that they concur in the recommendation of the Planning Commission and referred
<br />the matter to the City Attorney for the proper procedure, seconded by Councilman Weiss. Councilman Herkner
<br />amended the motion to concur with the recommendation of the Planning Commission with the exception of Lots
<br />1, 2, 3, 4, 5 and 6, Block 4, which should be left commercial, seconded by Councilman Spillers. The amend-
<br />ment lost on roll call with Councilmen Herkner, Spillers and Mayor Royer voting Yes, Councilmen Rosselli,
<br />Weiss, Weymouth voting No and Councilman Granger being noted absent. The original motion carried on roll
<br />call with Councilmen Herkner, Rosselli, Weiss and Weymouth voting Yes and Councilman Spillers and Mayor
<br />Royer voting No and Councilman Granger being noted absent.

<br />by Councilman Rosselli and carried on roll call, Councilman Granger being noted absent. The City Manager,
<br />prior to the adoption of the ordinance, notified the Council that the City had received the deed restrict-
<br />ion as requested at the April 28th Council meeting. The affidavit of publication wasordered filed.
