<br />INVOCATION was led by Reverend Ralph Benson, North Fair Oaks Community Churcho,
<br />ON ROLL CALL the following were noted present: Councilmen Floyd D. Granger, Sidney D. Herkner, John S. Rosselli,
<br />Robert V. Spillers, Louis Weiss, Ray Weymouth, Mayor William H. Royer, and City Clerk R. S. Dodge. Also
<br />present were City Manager J. E. Neal, City Engineer Glenn M. Jain, City Attorney Robert J. Costello, Water
<br />Superintendent H. L. Winter, Fire Chief J. L. Lodi, Building Inspector S. H. Kreiss, Planning Director
<br />William Rodgers, Police Chief William Faulstich, Assessor -Auditor John J. Brophy and Deputy City Clerk
<br />Vivian Holmquist.
<br />Councilman Spillers moved approval of the minutes of May 5th and May l2th as mailed, seconded by Councilman
<br />Rosselli and carried.
<br />Mayor Royer named Councilmen Herkner, Spillers and Weymouth as a committee to the Intercommunity Council with the
<br />City of Woodside.
<br />PUBLIC HEARING CONCERNING THE ESTABLISHMENT OF PLAN LINES ON REGENT STREET EXTENSION BETWEEN REDWO0D AVENUE AND
<br />APPROXIMATELY 2131 NWLY OF WOODSIDE ROAD, LOCATED BETWEEN OXFORD AND GORDON STREETS WITH A CONNECTING PLAN
<br />LINE BEVWN LOTS 7 AND 9 FROM REGENT STREET TO OXFORD STREET. The affidavit of notice was ordered filed.
<br />There being no protests, written or oral, Councilman Spillers moved that the public hearing be closed, sec-
<br />onded by Councilman Rosselli and carried. Councilman Spillers moved to instruct the City Attorney to pre-
<br />pare a resolution establishing plan lines in accordance with Planning Commission's recommendation, seconded
<br />by Councilman Weymouth and carried.
<br />PUBLIC HEARING ON THE PETITION OF WILLIAM & MARY EVA TO REZONE LOTS 1, 2 AND 32, BLOCK 4, CENTRAL PARK (700
<br />block James Avenue), FROM R-1 TO R -3-G DISTRICT. The affidavit of notice was ordered filed. A letter of
<br />protest was received from Mr. and Mrs. Egger. A petition with 110 signatures protesting the rezoning was
<br />presented to the Council. Mr. Michael Aa ronson, representing the applicants, addressed the Council and
<br />agreed to R-2 zoning in the event R 3-G zoning was denied. Councilman Spillers moved that the public hear-
<br />ing be closed, seconded by Councilman Rosselli and carried.
<br />Councilman Weymouth moved that they deny the petition for rezoning for the reasons reported by the Planning
<br />Commission, seconded by Councilman Spillers and carried.
<br />Councilman Rosselli moved adoption of ordinance amending Ordinance No. 600 to rezone Lots 1 through 17, Block 4;
<br />Lots 1 through 18, Block 6; Lots 1 through 20, Block 8, Belle Haven Subdivision, from C -3-H to R-3 (Bayshore
<br />Frontage), seconded by Councilman Weiss. The affidavit of publication was ordered filed. This was followed
<br />by discussion at which time the City Attorney ruled that Councilman Granger was not entitled to vote on this
<br />matter because he was not present at the public hearing. Themotion lost on roll call vote with Councilmen
<br />Rosselli, Weiss and Weymouth voting Yes, Councilmen Herkner and Spillers and Mayor Royer voting No, and Coun-
<br />cilman Granger being declared ineligible to vote on this matter.
<br />Councilman Spillers moved to instruct the City Attorney to bring in another ordinance rezoning the area from
<br />C -3-H to R-3 but eliminating the six lots from Fifth Avenue back, seconded by Councilman Herkner. Councilman
<br />Weiss said that consideration of the welfare as a whole rather than a benefit to an individual or a group of
<br />individuals should be given. Therefore, he feels that the Planning Commission considered and based their
<br />opinion as to the best benefit to the community as a whole and he suggested that the Council should act for
<br />the whole community rather than for an individual. Council man Spillers changed his motion to refer the
<br />matter back to the Planning Commission with the thought that they reconsider the first six lots, seconded by
<br />Councilman Herkner. After discussion by the City Attorney, Councilman Spillers withdrew his changed motion
<br />and went back to his original motion. Councilman Herkner withdrew his second and the motion lost for lack of
<br />a second.
<br />Councilman Rosselli moved to change the ordinance with the exception of Lots 3 and 4• This motion lost for
