uU� <br />TO C -1—H DISTRICT. Police Chief Faulstich, in a letter, reported that it was his understanding that a <br />question has been raised regarding an alleged violation of Section 25500 of the Alcoholic Beverage Control <br />Act by a principal in the rezoning of the property at Woodside Road and Alameda. He contacted Mr. Frank <br />Fullenwider, Area Administrator of the Department of Alcoholic Beverage Control, requesting an invest— <br />igation into this matter to determine if Section 25500 has been voilated. He will advise the Council <br />of the results of this investigation. <br />Robert De111Ergo, attorney for the applicant, filed with the Clerk an affidavit from Joseph B. Ferrando <br />stating that there was heretofore filed on his behalf and with his knowledge and consent and authorization, <br />as one of such owners, an application for rezoning of said property in the City of Redwood City. He also <br />filed a petition. Councilman Spillers moved to accept the documents as submitted and ordered them filed, <br />rrrll <br />seconded by Councilman Weymouth and carried on roll call, Councilman Weiss voting No and Councilman Granger <br />being noted absent. <br />After considerable discussion, Councilman Weiss moved that this application be denied and the applicant to <br />reinstitute his petition with the Planning Commission to give the Council an opportunity to contact the <br />State Engineers with regard to the change of zoning on Woodside Road. The motion lost for lack of a sec- <br />ond• <br />Mrs. Alice Rankine asked the Council to consider tabling this matter until after the report is received <br />from the State. Councilman Spillers moved introduction of the ordinance amending Ordinance No. 609, the <br />Zoning ordinance, to rezone Lots 11 to 13, inclusive, Block 6, Woodacre Knolls, being the northeast cor- <br />ner of Woodside Road and Alameda de las Pulgas from R-3 District to C -1-H District, seconded by Councilman <br />Weymouth. Councilman Weiss moved that the matter be tabled until the State's report is received. The <br />motion to table lost for lack of a second. This was followed by discussion with regard to an agreement ' <br />presented by Mr. Dell'Ergo between the owners and the City setting forth the guarantee stated by the attorney <br />for the owners at the public hearing that they would not build anything other than a restaurant and cocktail <br />lounge and remove the existing structure. No action was taken by the Council with regard to the agreement. <br />The motion to introduce the ordinance carried on roll call with Councilmen Herkner and Weiss voting no -,and <br />Councilman Granger being noted absent. <br />Councilman Spillers moved adoption of RESOLUTICK NO. 2508 OVERRULING DECISION OF BOARD OR ADJUSTMENTS AND GRANT- <br />ING VARIANCE IN FAVOR CF CERTAIN DESIGNATED PROPERTY (Golden K. Jones, 251 Jackson Street, to permit a 71 <br />rear yard setback instead of the required 151), seconded by Councilman Weymouth and carried on roll call, <br />Councilmen Herkner and Weiss voting no, Councilmen Rosselli, Spillers, Weymouth and Mayor Royer voking yes <br />and Councilman Granger being noted absent. <br />Councilman Herkner moved adoption of RESOLUTION N0. 2509 AUTHORIZING THE ABANDONMENT OF A CERTAIN PUBLIC UTILITY <br />EASEMENT IN BLOCK 9, REDWOOD TERRACE N0. 4, seconded by Councilman Weymouth and carried on roll call, Coun- <br />cilman Granger being noted absent. vaj <br />Councilman kosselli. moved adoption of RESOLUTION NO. 2510 GRANTING CONSENT OF THE CITY COUNCIL OF THE CITY CF <br />REDWOOD CITY FOR THE CONSTRUCTION OF A NEW SOURCE OF SUPPLY BY THE BELMONT COUNTY WATER DISTRICT, seconded <br />by Councilman Spillers and carried on roll call, Councilman Granger being noted absent. <br />Councilman Spillers moved adoption of RESOLUTION NO. 2511 AUTHORIZING AND APPROVING SUPPLEMENTAL AGREEMENT BE01 <br />- <br />3 <br />TWEEN CITY, FAIR OAKS SEWER MAINTENANCE DISTRICT,. AND THE COUNTY OF SAN MATEO, IN CONNECTION WITH ADDITIONS vmr <br />AND ENLARGEMENTS OF THE REDWOOD CITY SEWAGE TREATMENT PLANT AND ATTENDANT FACILITIES, seconded by Council- <br />man Rosselli and carried on roll call, Councilman Granger being noted absent. <br />Councilman Weiss moved that James MacDonald, Carl Tiedemann and Mitchell Webber's appointment to the Planning <br />Commission be extended for 30 days interim term, the City Manager to contact these men to see if they are <br />
