M. <br />Invocation was led by Reverend David Yoder, Assembly of God Church. <br />ON ROLL CALL the following were noted present: Councilmen Floyd D. Granger, Sidney D. Herkner, John S. <br />Rosselli, Louis Weiss, Ray Weymouth, Mayor William H. Royer and City Clerk -R. S. Dodge. Councilman <br />Spillers was noted absent because he was called to Sacramento. Also present were City Manager J. E. <br />Neal, City Attorney Robert J. Costello, Deputy City Engineer Mel Ntoen, Planning Director William <br />Rodgers, Water Superintendent H. L. Winter, Fire Chief J. L. Lodi, Building Inspector S. H. Kreiss, <br />Assessor -Auditor John J. Brophy, Fire Marshall George Asvos, Police Lt. Joel Mansfield, Police Sgt. <br />George Bold and Deputy City Clerk Vivian Holmquist. <br />PUBLIC HEARING ON THE PLANNING COMMISSIONIS RECOMMENDATION TO REZONE LOTS 3, 4 AND 6, BLOCK 9, KENSINGTON <br />SQUARE (southerly corner of Jefferson Avenue and Alameda de las Pulgas) FROM R-1 TO 0-4 DISTRICT. The <br />following letter from Attorney C. W. Lebsack was read by the City Attorney: <br />As you will recall at the meeting of August 18, 1958, some question was raised as to a <br />potential technical defect in the form of the application for -rezoning which was submitted <br />heretofore* <br />Investigation by this office and the office of the City Attorney discloses that such tech- <br />nical defects to exist. These defects cast some doubt on the jurisdiction of the Planning <br />Caymission and the Council to proceed with any action to rezone the property in question. <br />It is for that reason we are requesting that the application be withdrawn, and we shall re- <br />file a new application obviating any arguments relative to technical difficulties so that <br />the hearing itself can be conducted on the merits of the application and not be concerned <br />with the technical issues. <br />Councilman Herkner moved that the public hearing be closed and the matter taken off the agenda, second- <br />ed by Councilman Rosselli and carried. <br />PUBLIC HEARING ON REPORT AND ASSESSMENTS FOR WEED ABATEMENT. The Mayor received the report of the Street <br />Superintendent and proposed assessment list andordered the affidavit of posting and publication filed. <br />There being no protests, written or oral ,-Councilman Rosselli maned that the public hearing be closed, <br />seconded by Councilman Weymouth and carried. <br />Councilman Weymouth moved adoption of RESOLUTION NO. 2542 CONFIRMING REPORT OF SUPERINTENDENT CF <br />STREETS ON WEED ABATEMENT AND AUTHORIZING DELIVERY OF REPORT TO CITY TAX COLLEOTOR FOR THE ADDITION CF <br />THE ASSESSMENT AMOUNTS TO NEXT REGULAR TAX BILLS AGAINST PARTICULAR PARCELS CONCERNED,, seconded by <br />Councilman Rosselli and carried on roll call, Councilman Spillers being noted absent. <br />Councilman Herkner moved to adopt ORDINANCE NO. 910 REPEALING SECTION 1 CF ORDINANCE NO. 304$ BEING THE MEAT <br />MARKET CRDINANCE CF THE CITY OF REDWOC® CITY, TO REMOVE FROM SAID ORDINANCE ANY REGULATION OF THE HOURS <br />OF BUSINESS WHEN MEATS MAY BE SOLD OR DELIVEREDt seconded by Councilman Weiss and carried on roll call, <br />Councilman Rosselli voting no and Councilman Spillers being noted absent. The affidavit of publication <br />was ordered filed. <br />CONTINUATION OF PROCEEDINGS ON THE HEARING OF THE PLANNING COMMISSIONIS RESOLUTION CF INTENTION TO AMEND ORD- <br />DINANCE NO. 600 TO REZONE LOTS 2, 4 AND 6, AND PORTIONS OF LOTS 7, 8 AND 9, BLOCK I, AND LOTS 2 AND 4, <br />BLOCK B, WOCDSIDE ACRES MAP NO. 1 FROM R-2 TO R -3-G DISTRICT (Properties fronting on the west side of <br />Hudson Street from 398+ north of Palm Avenue to 5911 south of Palm Avenue to Palm Avenue) P. Co file <br />#58-147. Councilman Weymouth was disqualified from voting because he was not present at the time of the <br />public hearing. Councilman Rosselli moved that the recommendation of the Planning Commission be approved <br />and instructed the City Attorney to prepare an ordinance rezoning all the property from R-2 to R -3-G, <br />
