This amendment lost for lack of a second. Councilman <br />Granger moved to amend the motion to exclude lots 2 and 4s Block Be This amendment also lost for lack of <br />a second. The original motion carried on roll call vote with Councilmen Rosselli, Weiss and Mayor Royer <br />voting yes' Councilmen Granger and Herkner voting no, Councilman Weymouth being disqualified because of <br />reasons above and Councilman Spillers being noted absent. <br />PLANNING COMMISSION RECS INFORMAL APPROVAL OF A PROPOSED CUL-DE-SAC STREET IN "MARSHALL SQUARE". After <br />considerable discussion with regard to what is going to be planned for the property behind the cul-de-sac <br />and Bradford Street, Councilman Weiss moved that this matter be continued for one week and request that <br />someone from Mr. Draper's office be present to explain why they want the cul-de-sac, seconded by Council- <br />man Weymouth. Councilman Granger requested that a member of the Planning Commission also be present. The <br />motion carried. <br />CLADS FOR PERSONAL INJURY AND PROPERTY DAMAGE FILED BY MICHAEL SHATZKIN, BERTHA TOLOR AND MOLLY SHATZKIN. Coun- <br />cilman Weymouth moved to deny the claims and referred same to the insurance carrier, seconded by Councilman <br />Rosselli and carried. <br />DISCUSSION ABOUT TREES ON BROADWAY n&j:wwiti EL CAMINO REAL AND MAIN STREET AS REQUESTED BY COUNCILMAN F. GRANGER. <br />Councilman Granger reported that it was decided that such a program could not rest upon the decision of <br />individual merchants, but must be approached collectively through the Chamber of Commerce contacting and <br />representing all of the merchants. A permanent agreement must be formalized by the City and the Chamber <br />of Commerce in order to perpetuate the planting program and to avoid conflict with individual merchants <br />as the trees grew in size and interferred with window and sign visibility. He referred also to the matter <br />of tree spacing. Councilman Granger moved to refer this matter to the Chamber of Commerce for consideration <br />by the Beautification Committee, seconded by Councilman Rosselli and carried. <br />DISCUSSION OF STREET CONDITIONS IN THE VICINITY OF ORCHARD, CARLOS, RCBLE, NEUVA, ETC. AS REQUESTED BY COUNCILMAN <br />SPILLERS. Councilman Weiss moved to defer the question for one week until Councilman Spillers returns. <br />After discussion, Councilman Weiss changed his motion and moved that the information contained in the fact <br />sheet be sent to Councilman Spillers and if he wants to take the matter up further he can contact the <br />City Manager, seconded by Councilman Rosselli and carried. <br />COMMUNICATIONS: <br />R. W. FIELDS,, representing the HIGHLANDS COMWJNITY CLUB, stated in his letter that he talked to Mr. Mollar, <br />Vice President of the Wells Fargo Bank, who stated that they would accept either a quitclaim deed of the <br />City's interest to the Highlands Community Club, thereby removing the contingent interest retained by the <br />City, or in lieu of that would accept an agreement to be recorded between the Highlands Community Club <br />and the City with Wells Fargo Bank being a third party beneficiary to the effect that the City would <br />subordinate its rights in the property in the event of a default on the promissory note and deed of trust <br />to be held by Wells Fargo Bank and in the event of arW dissolution of the Club. Councilman Rosselli moved <br />that the City Attorney be instructed to prepare the necessary papers for subordination, seconded by Coun- <br />cilman Weiss who asked that the City Attorney also include in the agreement a pay -.off clause and a maximum <br />loan of $10,000.
