364 <br />PUBLIC HEARTNG ON THE PETITION OF JAMES P. & LORETTA M. HERLIHY to aVend Section 4.1 of Ordinance No. 600 to <br />rezone from R-1 District to R-3 District, rear portion of Lots 6 and 8 and all of Lot 7 of Finger Park <br />Tract located at 50 Finger Avenue. The public hearing was declared open and the affidavits of notice <br />ordered filed. The Clerk reported that he had a letter of protest from Frank & Ellen Crane, 90,Finger <br />Avenue. The Mayor recognized the petition filed with the Planning Commission protesting the rezoning. <br />Mr. Jamison, representing Mr. Herlihy, spoke in favor of the rezoning# and stated his reasons Why he <br />thought the rezoning should be granted. He said the 401 lot in front would be used for ingress and egress <br />only. Mura Stilleson, 43 Finger Avenue objected because the majority of the houses were single family dwel- <br />lings. She also spoke about the parking problem and the traffic in the area. Miss Stilleson did not cb- <br />ject to duplex zoning. Jack Klugman, 54 Finger Avenue, was in favor of R -3-G zoning for the whole block <br />arri <br />but he did not favor spot zoning. Councilman Weymouth moved that the public hearing be closed, seconded <br />by Councilman Granger and carried. <br />Councilman Granger moved to support the Planning Commission in their findings, deny the application and <br />terminate the proceedings (MINUTE ORDER ##59-186), seconded by Councilman Rosselli and carried. <br />PUBLIC HEARING ON THE PETITION OF JACK WERNER, JR. AND JACKIE LOU WERNER to amend section 4.1 of Ordinance No. <br />600 to rezone from R-1 District to R -3-G District, portion of Lot 3, Block 30 of Oak Knoll Manor located <br />at 642 Canyon Road. The public hearing was declared open and the affidavits of notice ordered filed. <br />There were no written communications and no one appeared to speak in favor,of-the rezoning. W. D. Staley, <br />631 Canyon Road, representing a group of people objecting to the rezoning and stated reasons why they ob- <br />jected. The main reasons for the objection were inadequate streets, lighting and other facilities. Coun- <br />cilman Rosselli moved that the public hearing be closed, seconded by Councilman Fields and carried. Coun- <br />cilman Herkner moved to deny the application and terminate the proceedings (MINUTE ORDER ##59-187), seconded <br />by Councilman Weymouth and carried. r <br />CONTINUATION OF PUBLIC HEARING ON BAYSHORE INDUSTRIAL PARK NO. 1 IMPROVEMENTS. The public hearing was declared <br />open. The Mayor explained to the people in the audience the action taken by the Council at the adjourned <br />meeting. Mr. Price stated that he would like to have the assessment district proceed. Councilman Weymouth <br />moved that the public hearing be closed, seconded by Councilman Herkner and carried. <br />Councilmanlosselli moved adoption of RESOLUTION NO, 2899 ORDERING ENGINEER TO FILE AMENDED REPORT, BAYSHORE <br />INDUSTRIAL PARK NO. 1 IMPROVEMENTS, seconded by Councilman Weymouth -and carried unanimously on roll call, <br />Councilman Spillers being noted absent. <br />Councilman Weymouth moved adoption of RESOLUTION N0. 2900 OVERRULING PROTESTS, BAYSHORE INDUSTRIAL PARK <br />NO. 1 IMPROVEMENTS, seconded by Councilman Granger and carried unanimously on roll call, Councilman Spillers <br />being noted absent. <br />Councilman Granger moved adoption of RESOLUTION NO. 2901 ORDERING ADOPTION OF ENGINEERIS REPORT, BAYSHORE <br />INDUSTRIAL PARK NO. 1 IMPROVEMENTS, seconded by Councilman Fields and carried unanimously on roll call., <br />Councilman Spillers being noted absent. <br />Councilman Herkner moved adoption of RESOLUTION NO. 2902 CONFIRMING ASSESSMENTS AND ORDERING WORK, BAY - <br />SHORE INDUSTRIAL PARK NO. 1 IMPROVEMENTS, seconded by Councilman Rosselli and carried unanimously on roll <br />call, Councilman Spillers being noted absent.
