9G <br />Said Budget; Providing for Emergency Expenditures, Transfers, Additional Appropriations and Cancellations <br />of Existing Appropriations;, and, Repealing, Ordinance No. 904 as Amended, and all Ordinances and Resolutions <br />in Conflict Herewith, " adopted June 22, 1959, to create the permanent position of Junior Typist -Clerk in <br />the Planning Department, seconded by Councilman Weymouth and carried. <br />ANNEXATION OF LOT 73 BLOCK 23 WOODSIDE KNOLLS SUBDIVISION (BRESSO ANNEXATION). The Mayor authorized the Clerk <br />to receive and file the report of the Boundary Commission. Councilman Weymouth moved adoption of RESOLU <br />TION N0, 2950 OF THE COUNCIL OF THE CITY OF REDWOOD CITY GIVING NOTICE CF., AND DECLARIM ITS INTENTION T0, <br />INITIATE ON ITS OffN MOTION PROCEEDINGS TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY; DESCRIBING SAID <br />TERRITORY AND DESIGNATING IT BY THE NAME CF "$RESSO ANNEXATION"; GIVING ITS REASONS FOR DESIRING SAID AN- <br />NEXATION; MAKING CERTAIN FINDINGS RESPECTING SAID PROCEEDINGS; AND GIVING NOTICE OF THE TME AND PLACE <br />SAID COUNCIL WILL HEAR PROTESTS TO SAID ANNEXATION, seconded by Councilman Herkner and carried unanimously most <br />on roll call, Councilman Spillers being noted absent. (Public hearing - February 29) <br />Councilman Herkner moved adoption of RESOLUTION NO. 2951 CONSENTING TO THE ABANDONMENT OF CERTAIN PARKING RE•- <br />STRICTIONS, LOT 71 BLOCK 12 REDWOOD TERRACE NO. 1, seconded by Councilman Fields and carried unanimously <br />on roll call, Councilman Spillers being noted absent. <br />LEGISLATIVE COMMITTEE REPORT: Councilman Herber read the following: <br />We have received notice from the League of California Cities that the Subcommittee of the Assembly <br />Interim Committee on Public Utilities and Corporations will hold hearings on certain Assembly <br />bills concerning the cost of installation and relocation of utility facilities, on January 13th <br />in Los Angeles. <br />Generally, under existing case law the costs of installing and relocating public utility facilities <br />in public rights of way must be borne entirely by the franchised public utility, i. e., when it be- <br />comes necessary to relocate PG&E and Pt&T facilities as a result of a street widening, etc., the <br />particular utility holding the franchise must relocate their facilities to coincide with the new <br />street right of way. <br />Two bills have been proposed which in effect would completely change the present law by imposing <br />an obligation on the city to pay for such relocation, which obligation has always previously been <br />that of the private utility consumers who obtain the benefit of theparticular facilities. These <br />bills are AB 2811 and AB 330. <br />The Committee recommends that the Council oppose the bills. Councilman Rosselli moved adoption of RESOLU <br />TION NO. 2952 STATING POSITION OF THE C C{TNCIL OF THE CITY OF REDWOOD CITY IN OPPOSITION TO ASSEMBLY BILLS <br />AB 2811 and AB 330, seconded by Councilman Granger and carried unanimously on roll call, Councilman Spillers <br />being noted absent. <br />COMMUNICATIONS: <br />Ampex Corporation requested the granting of a variance to Paragraph 4(b) of Resolution 2328 and Sidewalk <br />Ordinance No. 639, permitting the substitution of asphaltic concrete in areas designated for sidewalks. <br />Ampex has taken under lease two parcels of land on the west side of Broadway to be improved and utilized <br />for employee parking. Contingent upon the variance Ampex proposes to surface these lots with asphaltic <br />concrete right up to the curbing and separate the designated sidewalk area from the parking area by the <br />installation of header boards anchored to the surface. Councilman Herkner moved to grant the variance <br />(MINUTE ORDER #60-3), seconded by Councilman Granger and carried. <br />Councilman Spillers appeared at 9:011 p. m. <br />The City Attorney was authorzed to prepare the necessary revocable permit for Ampex Corporation. <br />Claims 31356 through 311.169, totaling $101,574.85, were ordered paid on motion of Councilman Spillers, seconded <br />by Councilman Fields and carried. <br />Councilman Herkner moved to adjourn the meeting to Thursday, January 7, 1960, at 4:00 p. m., Veterans Memorial <br />Building, Little Theater, seconded by Councilman Rosselli and carried.
