72 <br /> l <br /> The motion failed for lack of a second . <br /> MOTION : Titles having been read , Councilman Norris introduced the following reso- <br /> lutions and moved , seconded by Councilman Henderson , their adoption : <br /> Resolution No . 7091 Adopting a Fee Schedule for the Use of the Community <br /> Activities Building and the Recreation Center ; and Rescinding Resolution <br /> No . 5887 <br /> Resolution No 7092 Adopting a Fee Schedule for the Use of the Veterans <br /> Memorial Building ; and Rescinding Resolution No . 6479 <br /> The resolutions were adopted on the following roll call vote : <br /> Ayes : Councilmen Henderson , Leipzig , Norris , Weymouth and Mayor Keckley —" <br /> Noes : Councilman Rhodes <br /> Amendment to Personnel Rules and Regulations ( re disability retirements of local <br /> safety members ) <br /> City Manager Fales referred to his report of January 11 , 1974 regarding the proposed <br /> amendment to the Personnel Rules and Regulations concerning determination of dis - <br /> ability for retirement purposes for local safety members of PERS and to the report <br /> of January 10 from the Director of Personnel . <br /> Kerins O ' Connor , Association Representative of the Redwood City Police Officers <br /> Association , referred to his letter of January 14 and stated his organization has <br /> requested a meet and confer session concerning the proposed amendment . Mr . O ' Conner <br /> asked the Council to withhold adoption of the proposed amendment until such a ses - <br /> sion has been held . <br /> City Manager Fales advised that the subject of the proposed resolution amending the <br /> Personnel Rules and Regulations is a matter of implementing State law and is not <br /> subject to the meet and confer process . <br /> Assistant City Attorney Maloney advised that the City is required to make the deter- <br /> mination contained in the proposed amendment pursuant to specified sections of the <br /> Government Code and that the result of such proposed resolution , in part , is to in- <br /> crease benefits for safety personnel . <br /> Mr . O ' Connor directed attention to the first sentence of the final paragraph on <br /> Page 2 of the proposed resolution , stating his organization ' s objection to a pro - <br /> vision it interprets as preventing a person on disability from access to his bene - <br /> fits , and suggesting the provision may be in violation of the Labor Code . <br /> Mr . Fales and Mr . Maloney advised that the provision is not in violation of the law . <br /> MOTION : Title having been read , Councilman Henderson introduced the following reso- <br /> lution and moved , seconded by Councilman Weymouth , its adoption : <br /> Resolution No . 7093 Amending Section 4 of Rule 13 of the Personnel Rules and <br /> Regulations of the City of Redwood City <br /> SUBSTITUTE MOTION : Councilman Rhodes moved , seconded by Councilman Norris , to con- <br /> tinue consideration of the proposed resolution until January 21 , 1974 . <br /> The substitute motion failed by majority voice vote . <br /> The resolution was adopted on the following roll call vote : <br /> Ayes : Councilmen Henderson , Leipzig , Norris , Weymouth and Mayor Keckley <br /> Noes : Councilman Rhodes <br /> Consent Calendar <br /> Councilman Norris announced that the Housing Advisory Committee had their first <br /> meeting on Saturday , January 12 and plan to meet regularly at 7 : 00 p . m . on Thursdays <br /> in the Community Activities Building until this assignment is completed .
