Councilman Henderson moved to adopt RESOLUTION NO . 6944 TRANSFERRING THE SUM OF $ 5 , 500 FROM APPROPRIATION FOR TENNIS COURT LIGHTING AND $4 , 000 FROM APPROPRIATION FOR DEVELOPMENT OF STULSAFT PARK TO APPROPRIATION FOR IMPROVE- MENTS OF RED MORTON COMMUNITY PARK, and RESOLUTION NO , 6942 AWARDING CON- TRACT FOR CONSTRUCTION OF RED MORTON COMMUNITY PARK - PHASE I ; REJECTING ALL OTHER BIDS RECEIVED ; AUTHORIZING EXECUTION OF CONTRACT FOR SAID WORK ; AND DIRECTING RETURN OF SECURITY DEPOSIT , seconded by Councilman Williams and carried on roll call vote . The arrival of Mr . William Floyd , appointed to the Fair Oaks Advisory Board , was noted by Mayor Keckley , and presentation of Certificate of Appoint- ment was made to Mr , Floyd , who apologized for his inability to be present at the beginning of the meeting, due to the fact that he was teaching a class . Authorization to institute eminent domain proceedings - TOPICS Project , Phase II , northerly corner of Industrial Way and Whipple Avenue . Staff report indicated that a variance granted by Council on May 21 , to Section 29 . 19 of the Code relating to driveway location , subject to a condition for dedication of right of way , was now recommended to be rescinded . This was due to difficulty in acquiring the right of way in time to meet Federal deadline of June 30th for submittal of the required Right of Way Certifi - cate . Councilman Williams moved to rescind Variance granted by Council on May 21 , 1973 (Minute Order #73 - 66 ) , seconded by Councilman Weymouth and carried , (MINUTE ORDER #73 - 91 ) Councilman Weymouth moved to adopt RESOLUTION NO , 6943 OF THE COUNCIL OF THE CITY OF REDWOOD CITY FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION AND CONSTRUCTION BY THE CITY OF REDWOOD CITY OF A PUBLIC IMPROVEMENT , NAMELY, A PUBLIC STREET, IN AND UPON THAT CERTAIN REAL PROPERTY HEREIN DESCRIBED ; THAT THE ACQUISITION OF A RIGHT OF WAY AND EASEMENT IN SAID REAL PROPERTY HEREIN DESCRIBED IS NECESSARY FOR SAID PUBLIC IMPROVEMENTS ; AUTHORIZING THE CITY ATTORNEY TO BRING AN ACTION IN EMINENT DOMAIN TO ACQUIRE SAID REAL PROPERTY FOR SAID PUBLIC IMPROVEMENT AND TO APPLY FOR AN ORDER OF IMMEDIATE POSSESSION OF SAID REAL PROPERTY ; AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO DEPOSIT MONEY FOR IMMEDIATE POSSESSION OF SAID REAL PROPERTY , seconded by Council- man Norris and carried on roll call vote . 6/2 5/73 Reg .
