Mayor Keckley introduced Jacqueline Hildebrand as the new Acting City Clerk ,
<br /> effective October 15th , and City Clerk effective January 1st , 197k . Mayor
<br /> Keckley advised of the present City Clerk ' s retirement , effective December 31st ,
<br /> 1973 . He stated of the some twenty- seven very outstanding applicants inter-
<br /> viewed by Council Mrs . Hildebrand was unanimously selected , reciting as her back-
<br /> ground a University of California graduate , attendance at the Syracuse University,
<br /> New York , Institute for Municipal Clerks , and of having been City Clerk of the
<br /> City of Palo Alto for four years ( 1966-1970) .
<br /> Councilman Henderson moved to adopt RESOLUTION NO . 7002 APPOINTING JACQUELINE
<br /> HILDEBRAND AS ACTING CITY CLERK TO AND INCLUDING DECEMBER 31 , 1973 ; AND AS CITY
<br /> CLERK THEREAFTER ; and
<br /> Introduction of Ordinance adding Section 5 . 5 to Ordinance No . 1556 establishing
<br /> salary for position of Acting City Clerk, seconded by Councilman Weymouth and
<br /> carried unanimously on roll call vote , Councilman Rhodes being noted absent ,
<br /> Mayor Keckley congratulated Acting Police Chief George Bold on behalf of the
<br /> Council on his publicly announced appointment as Police Chief , effective
<br /> October 1st , at which time he was to be officially welcomed with appropriate
<br /> ceremonies .
<br /> Certificate of Distinguished Service presentation for William Warren for his past
<br /> community services as Member of the Park and Recreation Commission withheld
<br /> because of his absence .
<br /> Administration of Loyalty Oath rendered by City Clerk to William J . Price , newly
<br /> appointed member of the Planning Commission , and Allan Rollins , newly appointed
<br /> member of Park and Recreation Commission , with presentation to each of Certifi-
<br /> cate of Appointment by Mayor Keckley with expression of appreciation for their
<br /> w illingness to accept this community service as members of these two Commissions .
<br /> PUBLIC HEARING, Abatement of Nuisance , 115 Birch Street , two - story wooden frame
<br /> six-unit apartment building and detached garages , originally constructed in
<br /> 1897 , declared open and affidavit of posting ordered filed .
<br /> Chief Building Official Gyselbrecht was sworn in by the City Clerk , to present
<br /> the testimony from official report previously submitted to Council . He advised
<br /> that John Evans , Attorney representing holders of the first deed of trust on the
<br /> property and Jerrold Silverstein, new owner of the property , were present and
<br /> might wish to speak in their own behalf .
<br /> He also advised that both Mr . Evans and Mr . Silverstein had contacted him since
<br /> posting of the buildings and had indicated their willingness to cooperate with
<br /> his Department in any way possible .
<br /> It was also noted , since not included in his written report , that the building
<br /> on this site had sometime previously been converted from a single family dwelling
<br /> to that of the present six-unit apartments with no data in their research
<br /> evidencing this conversion had been performed with sanction of City . He also
<br /> advised that the apartment building was now occupied by three tenants , whom to
<br /> the best of his knowledge , speak only Spanish . He noted that the listing of the
<br /> owners in his submitted report did not now correspond to the evidently present
<br /> owners . He summarized the procedures that had been taken prior to the posting
<br /> o f the premises for abatement , from the owner of record , responding in a non-
<br /> definitive manner with reference to his hospitalization in Denver , and with
<br /> reference to the responsibility of Birch Properties as being the owners . He
<br /> noted his report indicated that not only his Department and the City Attorney ' s
<br /> office had made numerous attempts over a lengthy period of time to determine the
<br /> actual ownership and obtain a communication which would result in an effort to
<br /> rehabilitate or eliminate the inherent deficiencies of the subject building to
<br /> no avail . It was subsequent to posting the property that he had received
<br /> correspondence from two parties interested in the property but had not pre-
<br /> scribed that any affirmative action would be initiated . He stated their Depart-
<br /> ment was significantly concerned with the tenancy of the building since
<br /> apparently had been continually occupied by the Spanish speaking tenants making
<br /> it very difficult to relate the problems and hazards of the building they
<br /> occupied . Upon posting the Notice to Abate Nuisance the Building Department
<br /> informed all of the tenants by forwarding correspondence in Spanish and English ,
<br /> and no response had been received , although requested .
<br /> Estimated costs for rehabilitation reported as being in amount of $35 , 000 to
<br /> $ 40 , 000 , including correction of all deficiencies , demolition of the garage
<br /> structure , repairs unforeseen by outward findings and restoration to minimum
<br /> housing . Demolition estimated at $2500 to $3200 . The Building Department
<br /> recommended vacancy and demolition considering the advanced states of deteriora-
<br /> tion and that extensive rehabilitation did not appear economically feasible ,
<br /> describing more thoroughly the extensive apparent deficiencies because of lack
<br /> o f maintenance over the years , the garages being extraordinarily dilapidated and
<br /> littered with debris . Council Henderson commented on fact that Chief Building
<br /> Official ' s excellent submitted report , with full substantiation , left no doubt
