Councilman Weymouth particu- <br /> larly noted that the first proceedings had been initiated by the Building Depart- <br /> ment in July of 1972 . Chief Building Official stated attempts initiated at that <br /> time to determine responsible ownership . <br /> Mr . Jerrold Silverstein, after being sworn in to <br /> give testimony , advised he was now the sole owner of <br /> the property , having just received a quitclaim deed from <br /> previous holders of deed , and which had not as yet been <br /> recorded . <br /> He advised he was in complete agreement with Building <br /> Department ' s recommendation for demolition of the <br /> structures on the property as it would be economically <br /> unfeasible to do otherwise , He stated his main con- <br /> cern ^� <br /> was with the present tenants of the dwellings <br /> because of their now enjoying low rent . He noted <br /> foreseeable problems in relocating and asked for advice <br /> since he was not familiar with time schedules involved . <br /> City Attorney responded , if Resolution adopted by Council , declaring structures <br /> to be a public nuisance and directing the owners to abate , time schedule would be <br /> within 30 days and would also constitute notice to tenants to vacate property . <br /> He indicated that Mr . Silverstein consult his own attorney as to his own <br /> individual procedures . In response to questioning by Councilman Henderson of <br /> whether an insurance policy was in effect on the buildings since a communication <br /> on file indicated that it might not be , Mr . Silverstein advised of the transfers <br /> made and that it was in effect until March 13th . In response to question from <br /> Mayor Keckley as to whether he was not appearing in protest to these proceedings , <br /> Mr . Silverstein advised that he was not . <br /> Mr . John Evans , attorney representing the holders of <br /> the first deed of trust , Mr . and Mrs . Gleason , advised <br /> of having contacted Mr , Silverstein and their agreement <br /> that it was inevitable that demolition take place and <br /> had given assurance his clients would cooperate in <br /> seeing what could be recovered for all parties . <br /> City Attorney asked that Chief Building Official ' s report and photographs sub - <br /> mitted be made a part of the records . (For full text , see City Clerk ' s file - <br /> Abatement - 115 Birch Street) <br /> There being no further discussion , Councilman Williams moved to close the public <br /> hearing , seconded by Councilman Norris and carried . <br /> Councilman Weymouth moved to adopt RESOLUTION NO , 7003 DECLARING STRUCTURES LOCATED <br /> AT 115 BIRCH STREET IN THE CITY OF REDWOOD CITY TO BE A PUBLIC NUISANCE, DIRECT- <br /> ING THE OWNERS TO ABATE SAID NUISANCE, AND ORDERING THE EXPENSE OF ABATEMENT TO <br /> BE MADE A LIEN UPON THE LAND IN THE EVENT THE NUISANCE IS NOT ABATED BY THE <br /> OWNERS , seconded by Councilman Henderson and carried on roll call vote , Council- <br /> man Rhodes being noted absent . <br /> Councilman Henderson moved to adopt RESOLUTION NO , 7004 OF INTENTION TO ABANDON <br /> PUBLIC WALKWAY IN ACCORDANCE WITH PART 3 OF DIVISION 9, STREETS AND HIGHWAYS CODE <br /> OF THE STATE OF CALIFORNIA ; SETTING TIME AND PLACE FOR HEARING ALL PERSONS <br /> INTERESTED IN OR OBJECTING TO THE PROPOSED VACATION ; AND ORDERING POSTING OF <br /> NOTICE OF SUCH PROPOSED VACATION ( sets public hearing for October 15 , 1973 ) . <br /> Staff reported owners of Lots 1 and 18 had requested the abandonment of this <br /> 6-foot public walkway, extending between Oregon Avenue and Palm Avenue , adjacent <br /> to their properties for the purpose of eliminating vandalism . The walkway would <br /> then be incorporated into their property . Required fees reported received for <br /> this procedure and Environmental Impact Report was reviewed by the Planning <br /> Commission . Motion seconded by Councilman Norris and carried on roll call vote , <br /> Councilman Rhodes being noted absent . <br /> Councilman Williams moved to adopt RESOLUTION NO . 7005 APPROVING AND AUTHORIZING <br /> EXECUTION OF AGREEMENT FOR PERSONAL SERVICES FOR THE PREPARATION OF AN ENVIRON- <br /> MENTAL IMPACT REPORT . <br /> Staff report stated proposed agreement for services of Frahm, Edler & Cannis , for <br /> an Environmental Impact Report relating to Peninsula Covenant Church revision <br /> project and funding had been deposited with the City in the amount of $3 , 150 to <br /> compensate this firm for these services . The proposed project was reported to <br /> include a new sanctuary , a pedestrian bridge , and additional parking areas . <br /> Councilman Henderson questioned the paragraph in the proposed agreement relating <br /> to contractor ' s status with the City . City Attorney advised this was the usual <br /> statement contained in personal service agreements to establish legal relation- <br /> ship , as resolution provides for Environmental Impact Report by City with consul- <br /> tant , but fees paid by applicant , Councilman Henderson also questioned this <br /> 9/24/73 <br /> Reg .
