Request of City of Petaluma for participation by City for support in
their legal suit in Federal District Court for Northern District of
California , since relating to Planning regulations set by their City ,
and results of which suit could be of benefit to all cities , and public
agencies in the State of California .
City Attorney advised Council that ordinarily participation by City in
another City ' s legal suit in which City might wish to support would be
by amicus curiae , as had been done several times , He questioned
propriety of participation in monetary request made by City of Petaluma
for joining in this legal suit , which in effect would be support by
contribution to legal fees of attorneys involved therein .
Councilman Henderson commented on her extreme interest in this particu-
lar suit since having heard Mayor Putnam on several occasions and felt
it would behoove our City to participate since this same issue was
before our City also . Mayor Keckley noted that many decisions handed
down daily affecting cities and questioned whether this request had been
sent to all cities in the State , or just specific cities , since it was
evident City couldn ' t participate in this manner to other cities or set
such a precedent .
After further discussion as to legal status of City ' s participation and
evident need for more details , City Attorney was requested to contact
the City Attorney of Petaluma , as he had suggested , in order to gain
more particulars and report back to Council with a recommendation .
(Memo 9/27/73 )
Councilman Norris noted correspondence from Fire Chief Keller which had
been addressed to the City Manager and copies submitted to Council . He
felt this item deserved a note of recognition and indicate Council ' s
favorable reaction for his undertaking steps to further a fire preven-
tion program with no extra expense involved . Mayor Keckley stated all
of Council would join in commending Fire Chief Keller .
9/24/73
Reg , Mtg .
