He described <br /> problems which developed because the <br /> Architectural Committee attempted to apply <br /> conditions to an adjacent facility , while <br /> the application related only to the portion <br /> to be occupied by the Bubble Machine , He <br /> described efforts by Mr . Davies to meet <br /> requirements as they were imposed , and <br /> expressed the frustrations experienced due <br /> to apparently arbitrary decisions . He <br /> asked that Council consider their appeal <br /> on the basis that imposition of Conditions <br /> 1 and 16 was unreasonable , He added that <br /> they had no objection to either condition , <br /> as long as they applied only to Parcel A . <br /> Following considerable discussion , Councilman Rhodes moved to REVERSE the <br /> action of the Planning Commission . At the request of Councilman Keckley , <br /> who seconded the motion , the motion was amended for clarification to <br /> include stipulation that Conditions 1 and 16 apply to Parcel A containing <br /> the Bubble Machine operation only on which the Use Permit was granted , <br /> Mr . Albert Davies , 848 Arlington Road , <br /> advised in response to question by Council , <br /> that a portable restroom and other debris <br /> had been removed and cleaned up on the <br /> adjacent property . <br /> Councilman Henderson spoke in opposition to the motion , feeling that the <br /> position of the Planning Commission should be upheld . Motion carried on <br /> roll call vote , Councilman Henderson voting no and Councilman Petersen <br /> being noted absent . (MINUTE ORDER #72 -6) <br /> Elimination of Left Turn Traffic Movement , El Camino Real and Chestnut Street , <br /> and Installation of Divider Strip . <br /> The matter had been continued from meeting of January 10 , 1972 , to permit <br /> additional time to insure property owners affected were aware of the proposal . <br /> City Clerk reported a communication received this date from Antonio Roveta , <br /> owner of a building at the corner of Main and Chestnut , expressing concern <br /> as to the effect on businesses in this block , City Manager noted that his <br /> report to Council included results of a survey taken of businesses operating <br /> in that vicinity , Mayor Bury indicated he had contacted business operators <br /> in the area , except McDonald ' s , which he understood was planning to undertake <br /> major remodeling . <br /> Mr . Johnson , 160 Chestnut , expressed <br /> objection to eliminating the left turn <br /> at this intersection . <br /> Mr . Joe Sanchez , 132 Chestnut St . , operator <br /> of La Azteca. Mexicatessen , expressed <br /> concern that clientele would have to <br /> proceed South to "Five Points " in order <br /> to return . <br /> 1 - 17-72 <br />
