159 <br /> has tried to locate a 24-hour station where the unit <br /> can survive . He stated his Company would like <br /> consideration on these two stations so that the <br /> problem of elimination would not pose a burden to <br /> the dealers or to the customers that utilize them . <br /> Councilman Henderson brought out that it would appear the dealer <br /> and management relations were being imposed upon the City with regard <br /> to City ' s concerns , She reported being informed by another service <br /> station in that area that they had to remain open after 11 : 00 p , m , <br /> because they were required to stay open until 12 : 00 midnight in <br /> order to keep their franchise . In answer to her question of Council ' s <br /> ability to require compliance with the Ordinance without disrupting <br /> the service stations agreement , City Attorney advised that an Ordinance <br /> would supersede any agreement between private parties . <br /> It was brought out that Council ' s concern with respect to 24-hour <br /> operation related to noise and glaring lights at times of normal <br /> sleeping hours , and that they would not be denying the residents of <br /> Redwood City the use of 24 -hours service since at least one -third of <br /> the stations are on that schedule , In regard to variance provisions <br /> for an individual use permit , it was stated that City ' s variance <br /> procedures are very narrow and do not come under the use permit but <br /> rather with respect to lot frontage and size . <br /> Mr . Charles Richie , 220 Winslow Street , <br /> Redwood City, spoke in favor of the new <br /> Ordinance as he lives within 22 blocks <br /> of a 24-hour station and said he is well aware of <br /> the noise problem during sleeping hours . <br /> Mr . Peter Sears spoke in regard to the economic <br /> side of the oil companies ' objections and to <br /> their adding to the pollution problem . <br /> There being no further communications or oral discussion, Councilman <br /> Henderson moved to close the public hearing , seccn ded by Councilman <br /> Rhodes and carried , <br /> Councilman Norris moved to introduce Ordinance adding Section 2 , 90 and <br /> Article 35 to Ordinance No . 1130 , the Zoning Ordinance of the City <br /> of Redwood City, relating to Service Stations , seconded by Council- <br /> man Rhodes , <br /> After brief discussion on how the service stations were to be notified , <br /> it was Council ' s suggestion that a letter of notification, along with <br /> a copy of the Ordinance , be sent out by Staff to every service station <br /> in the City .
