246 There was a lengthy discussion , during which Mr . Gilsdorf asked that Council review action of the Building Department and make a final decision . Council informed him that Council did not have the authority to overrule decisions by the Chief Building Official . City Attorney concurred , and as indicated in his memorandum of November 30 , 1972 , the Board of Building Review has the final appellate jurisdiction on appeals from determinations by the Chief Building Official , Council had legislative authority, which was a different function , that is , Council can change laws , but once enacted , they must abide by that determination . With respect to any purported appeal in this instance , Council did not have the authority to act on it . Councilman Henderson felt that the term "arbitrary " with respect to findings of the Building Department was unfair , in view of the fact that the City was governed by the Uniform Building Code . Councilman Leipzig felt that this situation was reminiscent of discussion earlier in the meeting, where people go ahead with projects without benefit of permits or proper release from the City . Mayor Keckley indicated that he favored preservation of historical buildings , but that it would have to be a community type action . Councilman Williams advised that he would like to see the item continued , and to leave the door open , if possible , Mayor Keckley pointed out that if the developer had complied with the Code , it would not be necessary to hear the request now . With respect to designating historical sites , he suggested there were many different ways of doing this , and felt it should be investigated with the view of adopting an ordinance .
