436 <br /> additional information to Council . Council ' s Franchise Committee approved <br /> staff recommendation that the time of filing an annual report by CATV be changed <br /> to provide for more flexibility in the annual period , so that the annual <br /> audit report may be filed on a fiscal year basis , rather than calendar year <br /> basis as at present . If rate increase were approved , this would not become <br /> effective until approved by Federal Price Commission and certified to the City . <br /> Mr . Charles Griner, representing Peninsula <br /> Cable TV, invited questions from Council , <br /> asking that in their request for rate <br /> increase , it should be remembered that the <br /> service provided is non-essential and <br /> therefore subject to discretionary spending <br /> of citizens . They felt that a better <br /> service could be provided under a different <br /> rate structure . <br /> In response to question by Councilman Keckley he advised that he did not <br /> believe the firm had reached the subscriber saturation point , and among <br /> additional services , he indicated the possibility of a burglar alarm service <br /> and mentioned other programs that hopefully would stimulate more interest <br /> in their service . With regard to a feasibility study , he indicated he <br /> understood one had been done in 1967 , but that it was unavailable . <br /> Councilman Keckley referred to a letter dated March 1 , 1972 , from Mr . <br /> Sanford Levine , President, which requested correction of an error in the <br /> ordinance with respect to additional outlets , which indicates a charge of <br /> $1 . 00 per month, while their original application states a charge of $1 . 00 <br /> per month if paid annually in advance , otherwise the charge paid on a monthly <br /> basis is $1 . 25 . Mr . Griner felt that evidently this was an oversight on <br /> their part , as well as others . However, the company did accept the franchise <br /> and consequently, that apparently is to be the rate . He stated they would <br /> like to rectify the mistake by giving credit to those accounts affected , but <br /> that it would take some study and would require cooperative efforts with City <br /> Controller ' s office . For those no longer on the system , he indicated there <br /> would be some type of rebate . He indicated with cooperation of the Controller <br /> this should be completed within 60 days . Councilman Henderson felt it should <br /> go on record that this was primarily the responsibility of the CATV . She <br /> also pointed out that in the Company ' s advertising, there was never any <br /> indication that the rate for additional outlet was other than $1 . 25 , notwith- <br /> standing the rate set out in the franchise , nor did they indicate to prospective <br /> subscribers it was obtainable at a lesser rate if paid yearly in advance . <br /> Mr . Griner responded that they would encourage annual advance payment since <br /> it would simplify matters for them, although apparently it was not done in <br /> the past . He also noted there was not a substantial number of multiple <br /> subscribers . <br /> Councilman Keckley noted a number of things proposed to Council to be done <br /> by Peninsula Cable that had not in fact been done , and suggested that had <br /> they been done , their expenses would be even greater than at present .
