Still having problems with owners <br /> in what is known as Phase I , immediately adjacent to Canyon Road . Staff has <br /> concluded the only way to acquire this parcel would be by condemnation pro- <br /> cedure . This would mean City cannot have immediate right of possession and <br /> would have to proceed with the remainder of the project , as it can be afforded , <br /> and take in that piece whenever it becomes possible . Ribera & Sue is doing a - ' <br /> very preliminary sketch and schematic of what total area might look like , and <br /> Staff would recommend this be a passive type of park, with minimal develops <br /> ment . There was brief discussion concerning acquisition of property involved <br /> in Phase I , which if not obtained by negotiation would have to be authorized <br /> by Council for acquisition through power of eminent domain . City Attorney <br /> advised that it might take as long as a year before coming to trial . City <br /> Manager noted the parcels that already have been acquired for the park, and <br /> also noted that the property in Phase I was appraised realistically and <br /> represented fair market value , but the price asked was almost as much as for <br /> entire Phase II , and Staff could not recommend this , He also indicated that <br /> this portion was of lesser importance than other proposed acquisitions , and <br /> while it does have one potential access point from Canyon Road , the others <br /> have access from Glenwood and from Oak Knoll Drive via Hetch Hetchy . He felt <br /> the proper place for approaching the problem would be in the budget meetings , <br /> since it has to do with funding . City Attorney added that prior to filing <br /> order in the courts funds must be readily available . In response to Council � I <br /> question, City Manager indicated last negotiations took place approximately a <br /> month before .
