160 <br /> Councilman Keckley commented on alternate wording in recommendations in <br /> the Addendum of Planning Commission report , relating to requirement that <br /> parking areas and driveways , and required basic minimum front yards , not <br /> be included in computing usable open space ; and that each element of usable <br /> open space to be completely open on at least one side and have a clear <br /> vertical height of not less than seven feet , and not less than 50% of <br /> the total required usable open space be unobstructed to the sky , These <br /> recommendations were suggested at the Ordinance Review Committee level and <br /> it was felt more clearly defined the requirements . City Manager pro tem <br /> advised that following the Committee ' s meeting , the Planning Commission <br /> incorporated those alternates in their recommendation . On question from <br /> Council , he reviewed the effect the Ordinance would have , noting that <br /> although it has only been under study by the Planning Commission , it already <br /> had beneficial effect , in that the most recent plans for development of an <br /> apartment incorporated these standards , <br /> Councilman Petersen moved to close the public hearing , seconded by Councilman <br /> Keckley , <br /> Don Nystrom , building contractor of Menlo <br /> Park , indicated that under the proposed <br /> Ordinance , he would be unable to build a <br /> 42 -unit apartment project on Leahy Street , <br /> since density would be reduced to 32 units , <br /> In response to inquiry by Council , City Attorney advised to the effect that <br /> it was possible for the builder to proceed if a valid building permit is <br /> obtained before the effective date of the proposed Ordinance . Mr . Nystrom <br /> indicated that thirty days would be inadequate for the necessary procedures , <br /> It was noted by Council that the building plans had been pending for <br /> approximately five years , There was considerable Council discussion as <br /> to lack of quality of many of the apartments which had been permitted in <br /> the past , and the need to establish reasonable open space requirements , <br /> Dave Walker , 126 Cypress , asked what " open <br /> space " meant . <br /> City Manager pro tem responded with a review of the objectives and how they <br /> were proposed to be accomplished , <br /> Jan Michalski , realtor , 1736 El Camino Real , <br /> felt the proposed ordinance would reduce <br /> property value . <br /> Motion to close the public hearing carried , <br /> Councilman Keckley moved to introduce Ordinance amending Sections 6 , 9 , 6 . 12 , <br /> 7 . 9 , 7 . 11 , 8 . 9 , 9 . 9 , 10 , 9, and 32 , 3 of , repealing Sections 32 , 11 , 32 . 12 <br /> and 32 . 13 of , and adding Sections 32 , 11 , 32 , 12 , 32 . 13 , 32 , 14 , and 32 , 15 <br /> to , Ordinance No . 1130 , relating to Open Space Requirements , seconded by <br /> Councilman Williams and carried , <br />
